A BILL FOR AN ACT

 

relating to parental consent.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"453-______Parental consent of abortion on unemancipated minor. (a) No person shall knowingly perform an abortion upon an unemancipated minor female unless the attending physician or surgeon has secured the notarized, written consent of the minor's custodial parent or legal guardian.

(b) No consent shall be required under this section if:

(1) The attending physician or surgeon certifies that the abortion is necessary to prevent the death or substantial and irreversible impairment of a bodily function of the minor, and insufficient time exists to obtain the required parental consent.

(2) The minor elects not to obtain consent from her custodial parent or legal guardian and obtains an order from the Family Court dispensing with such a requirement. The court's decision shall be based on a finding that the minor is mature and capable of giving informed consent to the abortion."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
