A BILL FOR AN ACT

 

RElating to public employee health benefits.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that certain public employees who had more than five years but fewer than ten years of credited service and who were not able to retire before June 30, 1984, were required to pay approximately one-half their health insurance premiums, as opposed to their contemporaries who also had more than five but fewer than ten years of credited service but who were able to retire before June 30, 1984. Individuals in this latter group were not required to pay any premiums upon retirement. In 1984, the legislature enacted Act 252, Session Laws of Hawaii 1984, which required the State and the counties to pay specific monthly contributions, but not the entire cost, for those with more than five but fewer than ten years of service and who retired after June 30, 1984, toward their health benefits plan premiums.

The purpose of this Act is to rectify the inequity of treatment between the two groups of contemporaries who, but for the ability to retire before or after June 30, 1984, were required to pay differing amounts of premiums for their health benefit plans.

SECTION 2. Beginning on the effective date of this Act until June 30, 2003, and any other law to the contrary notwithstanding, including section 87-4.5, Hawaii Revised Statutes, any public employee specified in section 87-1(5)(A)(v), Hawaii Revised Statutes, with more than five years but fewer than ten years of credited service, and who retired in fiscal year 1985-1986 after December 1, 1985, but before December 31, 1985, shall be deemed to be an employee who retired before June 30, 1984, so that the provisions of section 87-4.5, Hawaii Revised Statutes, shall not apply to that employee.

SECTION 3. Beginning on July 1, 2003 when chapter 87, Hawaii Revised Statutes, is repealed, and any other law to the contrary notwithstanding, including section -34 of section 1 of Act 88, Session Laws of Hawaii 2001, any public employee specified in paragraph (1)(E) of the definition of "employee" in section -1 of section 1 of Act 88, Session Laws of Hawaii 2001, with more than five years but fewer than ten years of credited service, and who retired in fiscal year 1985-1986 after December 1, 1985, but before December 31, 1985, shall be deemed to be an employee who retired before June 30, 1984, pursuant to section -33(a)(4) of section 1 of Act 88, Session Laws of Hawaii 2001, for the purpose of the State and counties making base monthly contributions for a retiree's health benefit plan.

SECTION 4. This Act shall take effect upon its approval, except that section 2 shall be repealed on July 1, 2003.
