Your Committees on Transportation, Military Affairs and Government Operations and Tourism and Intergovernmental Affairs, to which was referred S.B. No. 475 entitled:

"A BILL FOR AN ACT MAKING AN APPROPRIATION TO STUDY THE FEASIBILITY OF CREATING A LOOKOUT AT HO'OKIPA ON THE HANA HIGHWAY,"

beg leave to report as follows:

The purpose of this measure is to appropriate funds to conduct a study regarding the feasibility of establishing a lookout and rest area at Ho'okipa on the Hana highway in Maui.

Your Committees received testimony in support of this measure from three members of the Maui County Council and from a concerned citizen. The Department of Transportation submitted testimony in opposition.

Your Committees find that construction of a lookout and rest area in the Ho'okipa area on the Hana highway makes sense for the public safety and welfare, and agrees that a study should be performed regarding the feasibility of such a project.

Based on testimony received at the hearing on this measure, your Committees find that the site of the current Ho'okipa Park may not be the best site for the proposed lookout. As an initial matter, your Committees believe that the Department of Transportation should carefully review the potential sites along Hana highway before proceeding with any plans for construction of a lookout. Your Committees amended this measure to insert such a requirement.

Your Committees also deleted the dollar amount of the appropriation and left it blank for determination by the Committee on Ways and Means.

As affirmed by the records of votes of the members of your Committees on Transportation, Military Affairs and Government Operations and Tourism and Intergovernmental Affairs that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 475, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 475, S.D. 1, and be referred to the Committee on Ways and Means.
