Sir:

Your Committee on Water, Land, Energy and Environment, to which was referred S.B. No. 1203, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO INCREASING DEVELOPMENT FLEXIBILITY OF PUBLIC LANDS,"

begs leave to report as follows:

The purpose of this measure is to allow for the disposition of public lands for airport-related purposes or activities, subject to the approval of the Board of Land and Natural Resources (BLNR).

Your Committee received testimony in support of this measure from the Department of Transportation (DOT) and the Airlines Committee of Hawaii.

Your Committee finds that current provisions regulating development of the Airport Division's lands and facilities allow the BLNR to issue only a thirty-day revocable permit for uses determined to be "non-aeronautical". This hampers the DOT's ability to make the most effective use of its land resources.

Your Committee finds that this measure will provide the DOT with greater leasing flexibility, as well as bringing the Airport Division's leasing criteria in line with Federal Aviation Administration standards.

As affirmed by the record of votes of the members of your Committee on Water, Land, Energy and Environment that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1203, S.D. 1, and recommends that it pass Third Reading.
