Sir:

Your Committee on Water, Land, Energy and Environment, to which was referred S.B. No. 1134 entitled:

"A BILL FOR AN ACT RELATING TO UNDERGROUND STORAGE TANKS,"

begs leave to report as follows:

The purpose of this measure is to transfer the balance of moneys remaining in the Hawaii capital loan revolving fund to the leaking underground storage fund to be used for education, outreach, inspections, and release response.

Your Committee received testimony in support of this measure from the Department of Business, Economic Development, and Tourism, Department of Health (DOH), Hawaii Automotive Repair & Gasoline Dealers, and Legislative Information Services of Hawaii.

Your Committee finds that moneys to be transferred are from fees collected between 1991 and 1994 from storage tank owners and operators, and that only two loans have been made to replace tanks or clean up tank sites since the fund was established in 1991. With passage of the December 1998 federal deadline for the replacement of older tanks, there is little demand for the funds in the capital loan revolving fund.

Your Committee finds that the transfer of these funds would provide additional resources and improved services for the underground storage tanks programs of the DOH. Your Committee has amended this measure to change the dollar amount of the moneys remaining in the capital loan revolving fund and the sum to be appropriated from the leaking underground storage tank fund and to make technical, nonsubstantive amendments to reflect the preferred drafting style.

As affirmed by the record of votes of the members of your Committee on Water, Land, Energy and Environment that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1134, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1134, S.D. 1, and be referred to the Committee on Ways and Means.
