Your Committee on Ways and Means, to which was referred H.B. No. 852, H.D. 2, S.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO PUBLIC EMPLOYMENT,"

begs leave to report as follows:

The purpose of this measure is to require salary and other cost adjustments for employees who are excluded from collective bargaining and who are not under the same classification systems as employees within collective bargaining units, to be at least equal to the adjustments provided to officers and employees in bargaining units (3), (4), and (13), as applicable.

Your Committee received testimony in opposition to this measure from the Department of Human Resources Development. The Public Employees Management Association of Hawaii commented on this measure.

Excluded employees under the same classification systems as employees within collective bargaining units refers mostly to nonmanagerial, civil service employees. Excluded employees not under the same classification systems as employees within collective bargaining units include cabinet members, managerial employees, nonmanagerial employees (e.g., deputy attorneys general), and civil service employees under the excluded managerial compensation plan.

Your Committee finds that salary and other cost adjustments for employees who are excluded from collective bargaining and who are not under the same classification systems as employees within collective bargaining units, should be at least equal to the adjustments provided under collective bargaining agreements for included employees. Variable salary and other cost adjustments based on performance or other job criteria should serve as incentives and not as punitive measures.

Your Committee has amended this measure by making technical nonsubstantive changes for purposes of clarity.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 852, H.D. 2, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 852, H.D. 2, S.D. 2.
