Your Committees on Economic Development and Technology and Water, Land, Energy and Environment, to which was referred H.B. No. 659, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO UNDERGROUND STORAGE TANKS,"

beg leave to report as follows:

The purpose of this measure is to allow for the transfer of funds from the Hawaii Capital Loan Revolving Fund to the department of Health Leaking Underground Storage Tank Fund (LUST), and to expand the permissible uses of moneys in the LUST Fund.

Your Committees received testimony in favor of this measure from the Department of Health and the University of Hawaii Environmental Center. Your Committees received comments on this measure from the Department of Business, Economic Development, and Tourism and Tax Foundation of Hawaii.

Your Committees find that the unused portion of the money collected from the owners of underground petroleum storage tanks and deposited in the State's revolving capital loan fund should be used by the Underground Storage Tank program. It is appropriate that these funds be used by the program to respond to actual leaks of petroleum, to conduct inspections at underground storage tank facilities, and for education and outreach.

As affirmed by the records of votes of the members of your Committees on Economic Development and Technology and Water, Land, Energy and Environment that are attached to this report, your Committees are in accord with the intent and purpose of H.B. No. 659, H.D. 2, and recommend that it pass Second Reading and be referred to the Committee on Ways and Means.
