Sir:

Your Committee on Agriculture, to which was referred H.B. No. 212, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO THE STATE WATER CODE,"

begs leave to report as follows:

The purpose of this measure is to appropriate funds for the implementation of the Agricultural Water Use and Development Plan.

Your Committee received testimony in favor of this measure from the Department of Agriculture (DOA), Department of Land and Natural Resources, Board of Water Supply of the City and County of Honolulu, Hawaii Farm Bureau Federation, Maui County Farm Bureau, Big Island Farm Bureau, and Pineapple Growers Association of Hawaii.

Your Committee finds that section 174C-31(c), Hawaii Revised Statutes, requires the DOA to prepare a comprehensive agricultural water use and development plan, including a master irrigation inventory plan for agriculture uses in the State. This measure provides the funds necessary for the DOA to develop and implement the plan.

Your Committee has amended this measure by replacing its contents with the Senate version, S.B. No. 460, S.D. 1, which differs from this measure by:

(1) Appropriating $750,000 for fiscal year 2001-2002 only to fund implementation of the plan; and

(2) Specifying an appropriation of $1 for each of the four plan objectives.

Technical, nonsubstantive amendments were also made to the S.D. 1 version for purposes of clarity.

As affirmed by the record of votes of the members of your Committee on Agriculture that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 212, H.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 212, H.D. 2, S.D. 1, and be referred to the Committee on Ways and Means.
