Your Committee on Commerce, Consumer Protection and Housing, to which was referred H.B. No. 16, H.D. 2, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO REAL ESTATE BROKERS AND SALESPERSONS,"
begs leave to report as follows:
The purpose of this measure is to exempt a time share interest owner from licensing under chapter 467, Hawaii Revised Statutes, when the owner refers a prospective buyer to the developer, sales agent, or resale agent of the owner's time share plan and receives a fee of not more than $1,000. The measure also clarifies the roles of owners, developers, sales agents, and resale agents.
Your Committee received testimony in favor of this measure from Hilton Grand Vacations Club and Dwyer, Imanaka, Schraff, Kudo, Meyer & Fujimoto. Your Committee received comments on this measure from the Department of Commerce and Consumer Affairs.
Your Committee finds that by limiting the amount of the referral fee to $1000 in a twelve-month period, the possibility of people using this measure as a way to bypass registration requirements is eliminated. This measure would benefit individual owners as well as the developer.
Your Committee has amended this measure by making technical, nonsubstantive changes for clarity.
As affirmed by the record of votes of the members of your Committee on Commerce, Consumer Protection and Housing that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 16, H.D. 2, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 16, H.D. 2, S.D. 2.
