Your Committee on Commerce, Consumer Protection and Housing, to which was referred H.B. No. 1173, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO LODGING OR TENEMENT HOUSES, HOTELS, AND BOARDINGHOUSES,"

begs leave to report as follows:

The purpose of this measure is to eliminate the business license requirement for lodging or tenement houses, hotels, boarding homes, and other types of group residences.

The City and County of Honolulu and Hawaii Hotel Association testified in support of this measure.

Currently, the law requires that lodging or tenement houses, group homes, group residences, group living arrangements, hotels, and boardinghouses have a county business license in order to operate. Your Committee finds that this requirement is unnecessary because these types of establishments are already subject to regulation under state health laws and county building and zoning codes. Therefore, this measure repeals the business license requirement.

As affirmed by the record of votes of the members of your Committee on Commerce, Consumer Protection and Housing that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1173, H.D. 1, and recommends that it pass Second Reading and be placed on the calendar for Third Reading.
