A BILL FOR AN ACT

 

RELATING TO THE GENERAL EXCISE TAX ON THE SALE OF FOOD.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 237, Hawaii Revised Statutes, is amended to read as follows:

"§237- Tax on food; three per cent rate. (a) Unless otherwise exempted by law, there is hereby levied, and shall be assessed and collected annually, a privilege tax equal to three per cent of the gross proceeds or gross income received or derived by persons engaging or continuing within the State in the business of selling food.

(b) As used in this section "food" means any food or food product purchased for immediate or home consumption.

(c) The director of taxation may adopt rules pursuant to chapter 91 to effectuate this section and to further define the term "food" if necessary."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2001.
