A BILL FOR AN ACT

 

relating to the board of education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. (a) There is established a commission on the election of the board of education, which shall be placed in the office of elections for administrative purposes. The commission shall:

(1) Determine methods to apportion districts for the election of members of the board of education (without regard to permanent residency as the only criterion for apportionment). The commission shall apply the principle of "one person, one vote";

(2) Recommend proposals to amend constitutional and statutory requirements affecting the composition of the board of education; and

(3) Report its findings and recommendations to the legislature.

(b) The commission shall be composed of the following nine members:

(1) Two members to be appointed by the board of education;

(2) Three members to be appointed by the governor; and

(3) Two members each to be appointed by the governor from lists of not less than five nominees each, submitted by the president of the senate and the speaker of the house of representatives, respectively.

(c) The department of education and the chief election officer shall provide staff and technical support to the commission.

(d) The members of the commission shall receive no compensation, but shall be reimbursed for travel and other necessary expenses incurred in the performance of their duties.

(e) The commission shall be convened before January 1, 2002, and shall elect a chairperson from among its membership by majority vote. The business of the commission shall be to prepare a report, including proposed legislation, to the legislature no later than twenty days before the convening of the regular session of 2003. The commission shall be disbanded upon the adjournment sine die of the 2003 regular session of the legislature.

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $        , or so much thereof as may be necessary for fiscal year 2001-2002, to carry out the purposes of this Act, including the hiring of necessary staff.

SECTION 3. The sum appropriated shall be expended by the chief election officer for the purposes of this Act.

SECTION 4. This Act shall take effect on July 1, 2001.
