A BILL FOR AN ACT

 

relating to disaster relief.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 127, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§127-    Adoption of hurricane resistant shelter criteria; construction of new public school buildings. The adjutant general/director of civil defense shall adopt hurricane resistant shelter criteria in accordance with chapter 91 to regulate the planning, design, construction, and equipping of new public school buildings that are built after June 30, 2001, and that are designated by the State or counties as hurricane shelters. The criteria adopted by the adjutant general/director of civil defense shall be consistent with the "Design and Construction Guidance for Community Shelters (FEMA 361)" published by the Federal Emergency Management Agency in July 2000."

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI to be appropriately designated and to read as follows:

"§302A-   Construction of new school buildings; conformance with hurricane resistant shelter criteria. (a) All new school buildings that are planned, designed, constructed, and equipped after June 30, 2001, and that are designated by the State or counties as hurricane shelters, shall be built in accordance with hurricane resistant shelter criteria adopted by the adjutant general/director of civil defense pursuant to section 127-   .

(b) The state civil defense director or the applicable county civil defense administrator, or both, shall designate which new school buildings are to serve as hurricane shelters. The designation of these buildings shall:

(1) Be based on their suitability for sheltering evacuees and on the need for additional shelter space within specific communities; and

(2) Give priority consideration to large interior spaces such as cafeterias, auditoriums, gymnasiums, and music buildings."

SECTION 3. The director of finance is authorized to issue general obligation bonds in the sum of $ , or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2001-2002 to enable all new school buildings that are planned, designed, constructed, and equipped after July 1, 2001, and that are designated by the State or counties as hurricane shelters, to be built in accordance with hurricane resistant shelter criteria adopted by the adjutant general/director of civil defense pursuant to section 127-   , Hawaii Revised Statutes, to the maximum extent feasible.

SECTION 4. The appropriation made for the capital improvement projects authorized by this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2004 shall lapse as of that date.

SECTION 5. The sum appropriated shall be expended by the department of accounting and general services for the purposes of this Act.

SECTION 6. New statutory material is underscored.

SECTION 7. This Act shall take effect on July 1, 2001.
