A BILL FOR AN ACT

 

RELATING TO IDENTIFICATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 710, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§710-    Sale or manufacture of deceptive identification document; penalties. (1) A person commits the offense of sale or manufacture of deceptive identification document if the person intentionally or knowingly manufactures, offers for sale, furnishes, offers to furnish, transports, offers to transport, imports, or offers to import into this State, a deceptive identification document unless there is printed the statement, "NOT A GOVERNMENT DOCUMENT". This statement shall be:

(a) Printed diagonally in bold capital letters across the face of the document;

(b) Not less than one-eighth of an inch in height; and

(c) Printed conspicuously and permanently on the document in permanent ink.

The name of the manufacturer shall also be printed conspicuously and permanently on the document.

(2) A person who violates this section shall be guilty of a class C felony.

(3) Any property used or intended for use in the commission of, attempt to commit, or conspiracy to commit an offense under this section, or which facilitated or assisted such activity, shall be forfeited pursuant to chapter 712A.

(4) As used in this section, "deceptive identification document" means any document not issued by a governmental agency of this State or any political subdivision thereof, another state, or the federal government, which purports to be, or which might deceive a reasonable person into believing that it is a document issued by such an agency, including but not limited to a driver's license, identification card, birth certificate, passport, or social security card."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
