STAND. COM. REP. NO. 23-00

                                 Honolulu, Hawaii
                                                   , 2000

                                 RE: H.B. No. 1762

Honorable Calvin K.Y. Say
Speaker, House of Representatives
Twentieth State Legislature
Regular Session of 2000
State of Hawaii

Sir:

Your Committee on Transportation, to which was referred H.B.
No. 1762 entitled:

"A BILL FOR AN ACT RELATING TO MOTOR CARRIERS,"

begs leave to report as follows:

The purpose of this bill is to clarify the scope of entities
subject to civil penalties for failing to comply with the
provisions of the Motor Carrier Law.

Your Committee finds that the present law identifies
"shipper or consignee", among others, as being subject to civil
penalties for failing to comply with the Motor Carrier Law.
Your Committee further finds that "shipper and consignee" are
thought of as being related to property, rather than passengers,
thus providing a potential loophole for passenger carriers.

This bill deletes the words shipper and consignee, and
replace them with the word "person" to indicate that all
carriers, whether they be property or passenger carriers, must
abide by the same rules.

As affirmed by the record of votes of the members of your
Committee on Transportation that is attached to this report, your
Committee is in accord with the intent and purpose of H.B. No.
1762 and recommends that it pass Second Reading and be referred
to the Committees on Consumer Protection and Commerce and
Judiciary and Hawaiian Affairs.

behalf of the members of the
