                    SENATE  RESOLUTION

  REQUESTING THE IMPLEMENTATION OF A SYSTEM-WIDE MASTER PLAN AND
    AN ACCOMPANYING INFORMATIONAL STUDY, ADDRESSING THE
    CURRENT AND PROJECTED NEED FOR PRISON FACILITIES IN
    HAWAII.


 1        WHEREAS, the Legislature finds that there is a need for
 2   the efficient use of the current prison and detention
 3   facilities, as well as a need for the State to build new prison
 4   and detention facilities to accommodate the overflowing number
 5   of inmates that are currently being sent to mainland prisons
 6   under contracts with the State; and
 7   
 8        WHEREAS, the Legislature finds that the State will realize
 9   a substantial economic benefit if State resources are used and
10   spent within the State for the construction and support of
11   State prison and detention facilities; and
12   
13        WHEREAS, the Legislature finds that a system-wide master
14   plan will help the State realize its goals for the development
15   and maintenance of the State prison system; and
16   
17        WHEREAS, the Legislature finds that a study (Study)
18   determining the operational and design objectives of the
19   existing and projected facilities is essential to the
20   development of a system-wide master plan; and
21   
22        WHEREAS, the Legislature further finds that incorporating
23   testimony and information from the Counties regarding zoning
24   and other County regulations into the Study is essential to the
25   development of a system-wide master plan; and
26   
27        WHEREAS, the purpose of this Resolution is to request the
28   creation of a master plan which will incorporate the findings
29   of the Study and address four major categories as follows:
30   
31        (1)  Mission and objectives of all pre-trial and
32             sentencing components of the Department of Public
33             Safety;
34   
35        (2)  Population profiles, projections, and bed needs with

 1             and without the use of alternatives to incarceration;
 2   
 3        (3)  Evaluation of existing facilities to determine bed
 4             capacity based on state and national standards and
 5             necessary improvements based on fire and life safety,
 6             and applicable building codes; and
 7   
 8        (4)  The development of a ten year master plan for the use
 9             of current facilities, additions, renovations, and
10             new facilities based on population projections and
11             the effect of alternatives to incarceration, taking
12             into account the effect that additions, renovations,
13             and new facilities may have on the Counties;
14   
15   now, therefore,
16   
17        BE IT RESOLVED by the Senate of the Twentieth Legislature
18   of the State of Hawaii, Regular Session of 2000, that a system-
19   wide master plan be designed and implemented and the
20   accompanying Study be conducted by the master plan executive
21   committee assisted by the Department of Public Safety and
22   appropriate agencies or departments to ensure the efficient
23   maintenance and development of Hawaii's prison system; and
24   
25        BE IT FURTHER RESOLVED that the Study be directed by the
26   master plan executive committee appointed by the Governor
27   consisting of members representing the Department of Public
28   Safety, the Executive Branch of the State, State Legislative
29   Corrections or the Judiciary Committee, and State Health and
30   Mental Health agencies; and
31   
32        BE IT FURTHER RESOLVED that the master plan executive
33   committee is directed to:
34   
35        (1)  Fund the Study by raising funds through private
36             partnerships;
37   
38        (2)  Hire a consultant qualified to advise the committee
39             regarding the design and management of prison and
40             detention facilities; and
41   
42        (3)  Make the Study available to the Office of the

 1             Governor, the Regular Session of 2001 of the
 2             Legislature, the Department of Public Safety, and
 3             other concerned departments or agencies;
 4   
 5   and
 6   
 7        BE IT FURTHER RESOLVED that the master plan executive
 8   committee, be assisted by members of the Department of Public
 9   Safety with experience in areas such as security, work
10   programs, physical and mental health treatment, prison
11   facilities management, prisoner intake and classification and
12   rehabilitation, and superintendents of existing Department of
13   Public Safety facilities; and
14   
15        BE IT FURTHER RESOLVED that the master plan executive
16   committee be directed to provide data, viable recommendations,
17   or options to the master plan executive committee; and
18   
19        BE IT FURTHER RESOLVED that the Department of Public
20   Safety assign additional personnel to assist the master plan
21   executive committee in areas such as population projections,
22   unique operational issues, and prison facility evaluations; and
23   
24        BE IT FURTHER RESOLVED that all State departments,
25   Counties, and governmental organizations shall cooperate with
26   the Study and provide requested information in a timely manner
27   to the master plan executive committee; and
28   
29        BE IT FURTHER RESOLVED that the master plan executive
30   committee report its findings and recommendations to the
31   Legislature twenty days before the convening of the Regular
32   Session of 2001; and
33   
34        BE IT FURTHER RESOLVED that certified copies of this
35   Resolution be transmitted to the Office of the Governor, the
36   Chief Justice of the Hawaii Supreme Court, the President of the
37   Senate, the Speaker of the House of Representatives, the
38   Director of Health, the Director of Public Safety, and the
39   Mayor of each county.
