                    SENATE  CONCURRENT
                        RESOLUTION
  REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO
    REVIEW CURRENT STATUTES TO DETERMINE WHETHER IT IS ILLEGAL
    AND WHETHER IT SHOULD BE ILLEGAL TO REMOVE AND SELL SAND
    FROM PUBLIC BEACHES.



 1        WHEREAS, the coastal zone management laws prohibit the
 2   taking of sand from shoreline areas except for personal,
 3   noncommercial use of one gallon per person per day; and
 4   
 5        WHEREAS, the state law also authorizes the counties to
 6   enact stricter provisions than the state laws; and
 7   
 8        WHEREAS, the state law on public lands also prohibits the
 9   taking of sand seaward from the shoreline except for personal,
10   noncommercial use of one gallon per person per day; and
11   
12        WHEREAS, nonetheless, it has been observed that sand from
13   the Punaluu Black Sand Beach is being removed and sold to
14   tourists by commercial operators; now, therefore,
15   
16        BE IT RESOLVED by the Senate of the Twentieth Legislature
17   of the State of Hawaii, Regular Session of 2000, the House of
18   Representatives concurring, that the Department of Land and
19   Natural Resources is requested to review current statutes to
20   determine whether it is illegal and whether it should be
21   illegal to remove and sell sand from public beaches; and
22   
23        BE IT FURTHER RESOLVED that the Department Land and
24   Natural Resources is requested to submit its findings and
25   recommendations to the Legislature not less than thirty days
26   prior to the convening of the Regular Session of 2001; and
27   
28        BE IT FURTHER RESOLVED that a certified copy of this
29   Concurrent Resolution be transmitted to the Chairperson of the
30   Board of Land and Natural Resources.
