                   A  BILL  FOR  AN  ACT

RELATING TO JURY VERDICTS.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 635-20, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§635-20  Less than unanimous verdict authorized.  (a)  In
 
 4 all civil cases tried before a jury it shall be sufficient for
 
 5 the return of a verdict if at least five-sixths of the jurors
 
 6 agree on the verdict.
 
 7      (b)  Except as otherwise provided in subsection (c), the
 
 8 verdict of a trial jury in a criminal action shall be by
 
 9 concurrence of at least ten of the twelve jurors.
 
10      (c)  A verdict of guilty for murder in the first degree,
 
11 murder in the second degree, attempted murder in the first
 
12 degree, or attempted murder in the second degree shall be by
 
13 concurrence of at least eleven of the twelve jurors."
 
14      SECTION 2.  This Act does not affect rights and duties that
 
15 matured, penalties that were incurred, and proceedings that were
 
16 begun, before its effective date.
 
17      SECTION 3.  New statutory material is underscored.
