                   A  BILL  FOR  AN  ACT

RELATING TO PUBLIC LANDS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 171-36, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  The board at any time during the term of any intensive
 
 4 agricultural, aquaculture, pastoral, or mariculture lease and
 
 5 when justified by sound economic practices or other
 
 6 circumstances, may permit an alternative agricultural,
 
 7 aquaculture, pastoral, or mariculture use or uses for any portion
 
 8 or portions of the land demised.  As a condition to permitting
 
 9 alternative uses, the board may require such other modifications,
 
10 including rental adjustments or changes in the lease as may be
 
11 necessary to effect or accommodate the alternative use or uses.
 
12 An alternative use or uses may be allowed by the board upon:
 
13      (1)  The application of the lessee;
 
14      (2)  Consent of each holder of record having a security
 
15           interest in the leasehold; and
 
16      (3)  A finding by the board that the alternative use or uses
 
17           are in the public interest."
 
18      SECTION 2.  New statutory material is underscored.

 1      SECTION 3.  This Act shall take effect upon its approval.
