                   A  BILL  FOR  AN  ACT

PROPOSING AN AMENDMENT TO ARTICLE X, SECTION 6, OF THE HAWAII
   CONSTITUTION, TO PROVIDE THE UNIVERSITY OF HAWAII WITH
   AUTONOMY IN ALL MATTERS RELATED TO THE UNIVERSITY.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to Article X, section 6, of the Constitution of the
 
 3 State of Hawaii to provide the University of Hawaii with autonomy
 
 4 in all matters related to the university.
 
 5      SECTION 2.  Article X, section 6, of the Constitution of the
 
 6 State of Hawaii is amended to read as follows:
 
 7                     "BOARD OF REGENTS; POWERS
 
 8      Section 6.  There shall be a board of regents of the
 
 9 University of Hawaii, the members of which shall be nominated
 
10 and, by and with the advice and consent of the senate, appointed
 
11 by the governor.  At least part of the membership of the board
 
12 shall represent geographic subdivisions of the State.  The board
 
13 shall have the power[, as provided by law,] to formulate policy,
 
14 and to exercise control over the university through its executive
 
15 officer, the president of the university, who shall be appointed
 
16 by the board[; except that the].  The board shall also have
 
17 exclusive jurisdiction over the internal organization and
 
18 management of the university.  This section shall not limit the
 
19 power of the legislature to enact laws of statewide concern."

 1      SECTION 3.  The question to be printed on the ballot shall
 
 2 be as follows:
 
 3      "Shall the University of Hawaii have the authority and power
 
 4      of self-governance in all matters related to the
 
 5      university?"
 
 6      SECTION 4.  Constitutional material to be repealed is
 
 7 bracketed.  New constitutional material is underscored.
 
 8      SECTION 5.  This amendment shall take effect upon compliance
 
 9 with Article XVII, section 3, of the Constitution of the State of
 
10 Hawaii.
