                   A  BILL  FOR  AN  ACT

RELATING TO THE PUBLIC EMPLOYEES HEALTH FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Act 309, Session Laws of Hawaii 1996, is amended
 
 2 by amending section 2 to read as follows:
 
 3      "SECTION 2.  (a)  The director of finance shall establish a
 
 4 committee [comprised of] comprising an equal number of
 
 5 representatives from [state] each of the following groups:
 
 6      (1)  State and county public employers [and public]; and
 
 7      (2)  Public employee organizations;
 
 8 to develop and recommend a proposal to implement an employer-
 
 9 union trust concept for determining and administering public
 
10 employee and retiree health benefits.  The state and county
 
11 public employers and the public employee organizations shall each
 
12 appoint a co-chair from among their respective committee members
 
13 to lead the committee.  The committee shall also include one
 
14 retired public employee, who shall be selected by the governor
 
15 from a list submitted by the public employees health fund.
 
16      (b)  The proposal shall include but not be limited to [a]:
 
17      (1)  A suggested trust structure and necessary statutory
 
18           changes to chapters 87 and 89, Hawaii Revised
 
19           Statutes[.]; and

 1      (2)  A plan to incorporate retirees into the trust
 
 2           structure.
 
 3      (c)  The director of finance shall submit [a report] three
 
 4 progress reports on the proposal to the legislature no later than
 
 5 November 21, 1999, May 15, 2000, and November 21, 2000,
 
 6 respectively.  The committee shall also submit annual action
 
 7 plans on the proposal to the legislature no later than [twenty
 
 8 days prior to the convening of the regular session of 1997.]
 
 9 November 1, 1999, and November 1, 2000.
 
10      (d)  The committee shall submit a final report to the
 
11 legislature on the proposal, including proposed legislation, no
 
12 later than twenty days prior to the convening of the regular
 
13 session of 2001.
 
14      (e)  The committee shall cease to exist on June 30, 2001.
 
15      (f)  The committee established by the director of finance
 
16 shall be exempt from chapters 91, 92, and 92F, Hawaii Revised
 
17 Statutes."
 
18      SECTION 2.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 3.  This Act shall take effect on August 1, 2001.
