                   A  BILL  FOR  AN  ACT

RELATING TO THE ELECTION OF THE BOARD OF TRUSTEES OF THE OFFICE
   OF HAWAIIAN AFFAIRS.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 13D-4, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]�13D-4[]]  Election of board members.  Members of the
 
 4 board of trustees shall be elected at a special election held in
 
 5 conjunction with the general election in every even-numbered
 
 6 year.  Except as otherwise provided by this chapter, members
 
 7 shall be nominated and elected in the manner prescribed by this
 
 8 title.
 
 9      The cost of conducting special elections to elect trustees
 
10 of the office of Hawaiian affairs shall be borne by the office of
 
11 Hawaiian affairs.  The chief election officer shall determine the
 
12 cost of conducting a special election and shall transmit a
 
13 request for reimbursement to the office of Hawaiian affairs
 
14 within ninety days of the completion of the special election.
 
15 The office of Hawaiian affairs, upon determining that the request
 
16 for reimbursement is accurate, shall remit payment to the chief
 
17 election officer within thirty days of the determination.
 
18      Nomination papers.  The chief election officer shall prepare
 
19 the nomination papers in such a manner that a candidate desiring

 1 to file for election to the board shall be able to specify
 
 2 whether the candidate is seeking a seat requiring residency on a
 
 3 particular island or a seat without such residency requirement.
 
 4      Ballot.  The board of trustees ballot shall be prepared in
 
 5 such a manner that every voter qualified and registered under
 
 6 section 13D-3 shall be afforded the opportunity to vote for each
 
 7 and every candidate seeking election to the board.  The ballot
 
 8 shall contain the names of all board candidates arranged
 
 9 alphabetically; provided that the names of candidates seeking
 
10 seats requiring residency on a particular island shall also be
 
11 grouped by island of residency.  Each eligible voter shall be
 
12 entitled to receive the board of trustees ballot and to vote for
 
13 the number of seats available."
 
14      SECTION 2.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 3.  This Act shall take effect upon its approval.
