                   A  BILL  FOR  AN  ACT

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 10-7, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]�10-7[]]  Board of trustees.  The office of Hawaiian
 
 4 affairs shall be governed by a board to be officially known as
 
 5 the board of trustees, office of Hawaiian affairs.  Members of
 
 6 the board shall be elected in accordance with chapter 13D, with
 
 7 reference to sections 11-15, 11-25, 12-5, 12-6, and vacancies
 
 8 shall be filled in accordance with section 17-7.  Members of the
 
 9 board shall devote full time to their duties as members of the
 
10 board.  No member shall hold any other public office or be in the
 
11 employment of the State or a county, or any department or agency
 
12 thereof, or any private organization that may bring the member
 
13 into conflict with the duties of the board during the member's
 
14 term."
 
15      SECTION 2.  Section 10-9, Hawaii Revised Statutes, is
 
16 amended to read as follows:
 
17      "�10-9 Salaries; benefit; expenses.  Members of the
 
18 board[:] shall:
 
19      (1)  [Shall receive an annual salary which shall be paid:

 1           (A)  Exclusively from revenue under section 10-13.5;
 
 2                and
 
 3           (B)  In equal amounts, beginning with the first pay
 
 4                period for state employees in November of the year
 
 5                the member of the board is elected.
 
 6           Effective July 1, 1993, and until the salary commission
 
 7           makes recommendations for salary, the salary of the
 
 8           chairperson of the board shall be $37,000 a year and
 
 9           the salary of other members of the board shall be
 
10           $32,000 a year.] Effective beginning with the first pay
 
11           period for state employees in November of the year
 
12           2000, receive a salary based on the recommendations of
 
13           the salary commission pursuant to section 10-9.5;
 
14           provided that the salary shall be paid exclusively from
 
15           revenue under section 10-13.5.  Any provision of law to
 
16           the contrary notwithstanding, all members of the board
 
17           shall be included in any benefit program generally
 
18           applicable to officers and employees of the State
 
19           except for benefit programs relating to retirements;
 
20      (2)  [Shall be] Be allowed transportation fares between
 
21           islands and abroad;
 
22      (3)  [Shall be] Be allowed personal expenses at the rates
 
23           specified by section 78-15, while attending board

 1           meetings or while on official business as authorized by
 
 2           the chairperson, when those board meetings or official
 
 3           business shall require a member to leave the island
 
 4           upon which the member resides; and
 
 5      (4)  [Shall be] Be allowed a protocol allowance to cover
 
 6           expenses incurred in the course of a member's duties
 
 7           and responsibilities."
 
 8      SECTION 3.  Statutory material to be repealed is bracketed.
 
 9 New statutory material is underscored.
 
10      SECTION 4.  This Act shall take effect on the day of the
 
11 special election for the office of Hawaiian affairs held in
 
12 conjunction with the general election in the year 2000.
