                   A  BILL  FOR  AN  ACT

PROPOSING AN AMENDMENT TO ARTICLE X, SECTIONS 2 AND 3, OF THE
   HAWAII CONSTITUTION RELATING TO THE BOARD OF EDUCATION.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to Article X, sections 2 and 3, of the Constitution of
 
 3 the State of Hawaii to provide for the elimination of the current
 
 4 statewide board of education, replacing it with four local boards
 
 5 elected by the people.
 
 6      SECTION 2.  Article X, section 2 of the Constitution of the
 
 7 State of Hawaii is amended to read as follows:
 
 8 
 
 9                   "[BOARD] BOARDS OF EDUCATION
 
10 
 
11      Section 2.  There shall be [a board] four local boards of
 
12 education composed of members who shall be elected in a
 
13 nonpartisan manner by qualified voters, as provided by law, from
 
14 [two at-large] four school board districts.  The first school
 
15 board district shall be comprised of the [island] county of
 
16 [Oahu and all other islands not specifically enumerated.  The
 
17 second school board district shall be comprised of the islands of
 
18 Hawaii, Maui, Lanai, Molokai, Kahoolawe, Kauai and Niihau.  Each
 
19 at-large school board district shall be divided into departmental

 1 school districts, as may be provided by law.  There shall be at
 
 2 least one member residing in each departmental school district.] 
 
 3 Hawaii. The second school board district shall be comprised of
 
 4 the county of Maui.  The third school board district shall be
 
 5 comprised of the county of Kauai.  The fourth school board
 
 6 district shall be comprised of the city and county of Honolulu.
 
 7 The Hawaii State Student Council shall select a public high
 
 8 school student to serve as a nonvoting member on [the] each board
 
 9 of education." 
 
10      SECTION 3.  Article X, section 3 of the Constitution of the
 
11 State of Hawaii is amended to read as follows:

13             "POWER OF THE [BOARD] BOARDS OF EDUCATION
 
14 
 
15      Section 3.  The four [board] boards of education shall each
 
16 have the power, as provided by law, to formulate [statewide]
 
17 district wide educational policy, exercise control over budgetary
 
18 and personnel matters, and appoint [the]a superintendent of
 
19 education as the chief executive officer of [the public school
 
20 system.] each respective school board district." 
 
21      SECTION 4.  The question to be printed on the ballot shall
 
22 be as follows:
 
23      "Shall the current constitutional provisions on the creation

 1 and power of the Board of Education be amended to provide for the
 
 2 elimination of the statewide Board of Education, replacing it
 
 3 with a total of four local school boards elected by the people?"
 
 4      SECTION 5.  Constitutional material to be repealed is
 
 5 bracketed.  New constitutional material is underscored.
 
 6      SECTION 6.  This amendment shall take effect upon compliance
 
 7 with article XVII, section 3, of the Constitution of the State of
 
 8 Hawaii.
