                   A  BILL  FOR  AN  ACT

RELATING TO HANAMAULU BAY, KAUAI.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Findings and purpose.  The legislature finds
 
 2 that by prohibiting fishing in certain areas, the ocean life
 
 3 bounces back and corals and fish varieties return to healthy
 
 4 levels over time.  This has happened in Hanauma Bay on Oahu and
 
 5 other areas on other islands.  Some prohibitions have been
 
 6 adopted by rule, as in the case of Hanamaulu Bay on Kauai.
 
 7      The purpose of this Act is to displace these prohibitions
 
 8 which give the department of land and natural resources the
 
 9 controlling authority over Hanamaulu Bay and adopt a law that
 
10 prohibits certain fishing activities in Hanamaulu Bay and Ahukini
 
11 recreational pier, which is the public pier located in Hanamaulu
 
12 Bay.
 
13      SECTION 2.  Chapter 188, Hawaii Revised Statutes, is amended
 
14 by adding a new section to part II, to be appropriately
 
15 designated and to read as follows:
 
16      "�188-     Hanamaulu Bay, Ahukini recreational pier,
 
17 prohibited activities.  No person shall engage in the following
 
18 activities within Hanamaulu bay, located on the eastern portion
 
19 of the island of Kauai, or on the Ahukini recreational pier,

 1 which is the public pier located in Hanamaulu Bay:
 
 2      (1)  Use any spear while SCUBA or skin diving.
 
 3      (2)  Use any draw, drag, gill, seine, or any other type of
 
 4           net except thrownet and crab net within the Ahukini
 
 5           recreational pier portion of Hanamaulu Bay bounded by
 
 6           the breakwater, thence along a straight line from the
 
 7           tip of the breakwater westward to Hanamaulu point.
 
 8      (3)  Use any thrownet in Hanamaulu Bay within fifty yards of
 
 9           the Ahukini recreational pier or from the adjoining
 
10           abandoned pier frame.
 
11      (4)  Conduct any sort of swimming, SCUBA, or skin diving
 
12           activities within the Ahukini recreational pier portion
 
13           of Hanamaulu Bay within fifty yards of the Ahukini
 
14           recreational pier or from the adjoining abandoned pier
 
15           or frame.
 
16      (5)  Snag any fish or possess any thrownet while on the
 
17           Ahukini recreational pier or from the adjoining
 
18           abandoned pier frame."
 
19      SECTION 3.  New statutory material is underscored.
 
20      SECTION 4.  This Act shall take effect upon its approval.
