                   A  BILL  FOR  AN  ACT

MAKING AN APPROPRIATION TO THE HONOLULU POLICE DEPARTMENT TO
   REIMBURSE IT FOR THE COSTS INCURRED IN ACTING AS THE STATE
   OF HAWAII CONTROL TERMINAL AGENCY FOR BOTH THE NATIONAL
   CRIME INFORMATION CENTER AND NATIONAL LAW ENFORCEMENT
   TELECOMMUNICATIONS SYSTEM NATIONWIDE CRIMINAL JUSTICE
   INFORMATION SYSTEMS, AND TO SUPPORT THE IMPLEMENTATION COSTS
   OF THE NEW NATIONAL CRIME INFORMATION CENTER 2000 SYSTEM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that there is a critical
 
 2 need to provide continuing access to nationwide criminal justice
 
 3 information systems for all criminal justice agencies in Hawaii.
 
 4 This need is evidenced by the growth in the number of agencies
 
 5 that access this information as well as the increase in the
 
 6 number of computer transactions generated by Hawaii's criminal
 
 7 justice agencies over the past ten years.
 
 8      In each state, a law enforcement agency is designated as the
 
 9 control terminal agency, or coordinating agency, for the National
 
10 Crime Information Center (NCIC) and National Law Enforcement
 
11 Telecommunications System (NLETS) systems.  The Honolulu police
 
12 department has acted as the Hawaii control terminal agency for
 
13 both systems for over fifteen years.  It is accepted throughout
 
14 the country that it is a state responsibility to provide the
 
15 services of the National Crime Information Center and National
 
16 Law Enforcement Telecommunications System to each state's

 1 criminal justice agencies.  In fact, Hawaii is the only state in
 
 2 which a local, or non-state level agency acts as the control
 
 3 terminal agency.
 
 4      Although the Honolulu police department has borne the costs
 
 5 associated with the responsibilities of the control terminal
 
 6 agency to date, several issues have arisen over the past several
 
 7 years that make this arrangement impossible to continue.
 
 8 Increases in the number of criminal justice agencies and their
 
 9 employees who utilize these systems have drastically increased
 
10 the workload associated with the training, testing and auditing
 
11 that must be completed by the control terminal agency.  Travel
 
12 costs associated with this increased workload have also
 
13 escalated.  The estimated annual cost to the Honolulu police
 
14 department associated with the management of the NCIC and NLETS
 
15 systems is $225,000.
 
16      In addition, the NCIC system is being completely redesigned
 
17 to take advantage of technological advancements in the electronic
 
18 transmission of text and image data.  The new system, called NCIC
 
19 2000, became operational in July, 1999.  All states must be able
 
20 to interface with the new system in 2002, as the current NCIC
 
21 system will cease to exist.
 
22      The Honolulu police department hired a consultant to help in
 
23 the planning for the NCIC 2000 system.  The Honolulu police

 1 department estimated the cost of developing and implementing the
 
 2 new NCIC 2000 system at $1,500,000.  The Honolulu police
 
 3 department, through several different federal grants, has
 
 4 acquired $650,000 for the development of the system.  The
 
 5 remaining funding needed to develop the system is $850,000.
 
 6      SECTION 2.  There is appropriated out of the general
 
 7 revenues of the State of Hawaii the sum of $1,075,000, or so much
 
 8 thereof as may be necessary for fiscal year 2000-2001, for the
 
 9 Honolulu police department to act as the state control terminal
 
10 agency for the State of Hawaii.
 
11      SECTION 3.  The sum appropriated shall be expended by the
 
12 city and county of Honolulu for the purposes of this Act.
 
13      SECTION 4.  This Act shall take effect on July 1, 2000.
