                   A  BILL  FOR  AN  ACT

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 88-24, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�88-24 Composition of board.  The board of trustees shall
 
 4 consist of [eight members as follows:
 
 5      (1)  The director of finance of the State, ex officio;
 
 6      (2)  Four members of the system, two of whom shall be
 
 7           general employees, one of whom shall be a teacher, and
 
 8           one of whom shall be a retirant to be elected by the
 
 9           members and retirants of the system under rules adopted
 
10           by the board governing the election to serve for terms
 
11           of six years each, one of the terms to expire on
 
12           January 1 of each even-numbered year; provided that, if
 
13           after the close of filing of petitions for candidacy, a
 
14           member is unopposed for election to a trustee position,
 
15           the member shall be deemed and declared to be duly and
 
16           legally elected to the position of trustee without an
 
17           election; and
 
18      (3)  Three citizens of the State who are not employees, one
 
19           of whom shall be a responsible officer of a bank
 
20           authorized to do business within the State, or a person

 1           of similar experience, to be appointed by the governor,
 
 2           with the advice and consent of the senate, to serve for
 
 3           a term of six years each, one of the terms to expire
 
 4           January 1 of each odd-numbered year.]
 
 5 an equal number of employee and public employer representatives.
 
 6 The employee representatives shall consist of one representative
 
 7 from each of the organizations certified as an exclusive
 
 8 representative for state and county employees and one retiree of
 
 9 the employees' retirement system to be elected by the members and
 
10 retirees of the system under rules adopted by the board governing
 
11 the election to serve for a term of six years to expire on
 
12 January 1 of the sixth year; provided that if after the close of
 
13 filing of petitions for candidacy, a member is unopposed for
 
14 election to a trustee position, the member shall be deemed to be
 
15 duly elected to the position of trustee without an election.  The
 
16 public employer representatives shall consist of two
 
17 representatives from the State appointed by the governor, two
 
18 representatives from the city and county of Honolulu appointed by
 
19 the mayor, and a representative from each of the three remaining
 
20 counties appointed by the mayor of the respective county.  If the
 
21 number of employee organizations changes, and there is a need for
 
22 a reduction or increase in the number of employer
 
23 representatives, the employer representatives listed above shall

 1 determine which jurisdiction representatives shall be deleted or
 
 2 added.  Each trustee shall serve until the trustee's successor is
 
 3 elected or appointed, as the case may be, and qualified.  [For
 
 4 the purpose of this section, the term "general employees"
 
 5 includes police officers and firefighters.]"
 
 6      SECTION 2.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect on January 1, 2001.
