                   A  BILL  FOR  AN  ACT
RELATING TO VOTER REGISTRATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 11-17, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�11-17  Removal of names from register, when;
 
 4 reregistration.(a)  The clerk, not later than 4:30 p.m. on the
 
 5 sixtieth day after every general election, shall remove the name
 
 6 of any registered voter [who did not vote in that general
 
 7 election, and also did not vote in the primary election preceding
 
 8 that general election, and also did not vote in the previous
 
 9 general election, and also did not vote in the primary election
 
10 preceding that general election, and also did not vote in the
 
11 regularly scheduled special elections held in conjunction with
 
12 those primary and general elections, if any,] in accordance with
 
13 the National Voter Registration Act of 1993 or other federal
 
14 laws, with the exception of:
 
15      (1)  Those who submitted written requests for absentee
 
16           ballots as provided in section 15-4; or
 
17      (2)  Anyone who preregistered pursuant to section 11-12(b).
 
18 If a person voted, at least once, in [any of the above-mentioned
 
19 elections,] that general election or the primary election
 
20 preceding that general election; or voted in the previous general

 1 election, or in the primary election preceding that general
 
 2 election; or voted in any special election held within these
 
 3 election cycles the person's name shall remain on the list of
 
 4 registered voters.  For this purpose "vote" means the depositing
 
 5 of the ballot in the ballot box whether the ballot is blank or
 
 6 later rejected for any reason.  In the case of voting machines
 
 7 "vote" means the voter has activated the proper mechanism and fed
 
 8 the vote into the machine.
 
 9      (b)  The clerk, after having complied with the provisions of
 
10 the National Voter Registration Act of 1993 or other applicable
 
11 federal laws, shall also identify or remove the name of any
 
12 registered voter[, if the clerk, after mailing a notice or other
 
13 correspondence, properly addressed, with postage prepaid,
 
14 receives the notice or other correspondence as return mail with a
 
15 postal notation that the notice or other correspondence was not
 
16 deliverable.  On election day, any person identified or removed
 
17 shall have the person's name corrected or restored in the
 
18 register and shall be allowed to vote if the person completes an
 
19 affidavit or other form prescribed by the chief election officer
 
20 affirming that the person:  claims the person's legal residence
 
21 at the address listed on the register; changed the person's legal
 
22 residence after the closing of the register for that election;
 
23 or, moved to a new residence within the same precinct as the

 1 person's residence as listed on the register.] from the register
 
 2 of voters.
 
 3      (c)  On elections day, any person identified or removed
 
 4 shall have the person's name corrected or restored in the
 
 5 register and shall be allowed to vote if the person completes an
 
 6 affidavit or other form prescribed by the chief election officer
 
 7 affirming that the person:
 
 8      (1)  Claims the person's legal residence at the address
 
 9           listed on the register;
 
10      (2)  Changed the person's legal residence after the closing
 
11           of the register for that election; or
 
12      (3)  Moved to a new residence within the same precinct as
 
13           the person's residence as listed on the register.
 
14      [(c)] (d)  The clerk may remove the name of any registered
 
15 voter, if the voter so desires and properly notifies the clerk
 
16 pursuant to the procedures established by the chief election
 
17 officer.
 
18      [(d)] (e)  Any person whose name has been removed from the
 
19 register, at any time prior to the closing of the register, as
 
20 provided in section 11-24, may have that person's name restored
 
21 in the register by presenting oneself to the clerk and
 
22 reregistering pursuant to section 11-15, or by making application
 
23 by mail or otherwise pursuant to procedures established by the

 1 clerk.  The clerk shall require satisfactory evidence to
 
 2 establish the identity of the applicant.  The names of all those
 
 3 persons shall be reentered in the register."
 
 4      SECTION 2.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 3.  This Act shall take effect upon its approval.
