                   A  BILL  FOR  AN  ACT

RELATING TO THE GENERAL POWERS OF THE UNIVERSITY OF HAWAII.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 304-2, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�304-2 University to be public corporation; general
 
 4 powers.  The University of Hawaii is established as the state
 
 5 university and constituted a body corporate.  The university,
 
 6 under the direction of the board of regents, shall have the
 
 7 following general powers:
 
 8      (1)  To adopt, amend, and repeal bylaws governing the
 
 9           conduct of its business and the performance of the
 
10           powers and duties granted to or imposed upon it by law.
 
11      (2)  To acquire in any lawful manner any property, real,
 
12           personal, or mixed, tangible or intangible, or any
 
13           interest therein; to hold, maintain, use, and operate
 
14           the same; and to sell, lease, or otherwise dispose of
 
15           the same at such time, in such manner, and to the
 
16           extent deemed necessary or appropriate to carry out its
 
17           purposes.
 
18      (3)  To enter into and perform such contracts, leases,

 1           cooperative agreements, or other transactions as may be
 
 2           necessary in the conduct of its business and on such
 
 3           terms as it may deem appropriate, with any agency or
 
 4           instrumentality of the United States, or with any
 
 5           state, territory, or possession, or with any political
 
 6           subdivision thereof, or with any person, firm,
 
 7           association, or corporation.
 
 8      (4)  To determine the character of and the necessity for its
 
 9           obligations and expenditures, and the manner in which
 
10           they shall be incurred, allowed, and paid, subject to
 
11           provisions of law specifically applicable to the
 
12           university.
 
13      (5)  To execute, in accordance with its bylaws, all
 
14           instruments necessary or appropriate in the exercise of
 
15           any of its powers.
 
16      (6)  To enter into joint funding arrangements with one or
 
17           more public or private entities to pay the salary and
 
18           fringe benefits of any university officer or employee,
 
19           and to expend such sums of money as may be from time to
 
20           time placed at the disposal of the university under
 
21           section 304-7 to supplement the compensation of any
 
22           university officer or employee.

 2           to carry out the powers conferred upon it by law."
 
 3      SECTION 2.  New statutory material is underscored.
 
 4      SECTION 3.  This Act shall take effect upon its approval.
