                   A  BILL  FOR  AN  ACT

RELATING TO NEW CENTURY CHARTER SCHOOLS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the purpose of this
 
 2 Act is to define new century charter schools as schools that
 
 3 utilize an alternate educational framework and are governed by an
 
 4 independent governing board.  In addition, this measure creates a
 
 5 process whereby new century charter schools may be established.
 
 6      SECTION 2.  Section 302A-1185, Hawaii Revised Statutes, is
 
 7 amended by amending subsection (a) to read as follows:
 
 8 "(a)  New century charter schools shall receive an allocation of
 
 9 state general funds based upon the operational and educational
 
10 funding requirements of the schools; provided that:
 
11      (1)  Beginning in fiscal year [1999-2000,] 2000-2001, and
 
12           every year thereafter, the [auditor] superintendent
 
13           shall determine the appropriate allocation based on the
 
14           total department general fund appropriation and per
 
15           pupil expenditure for the previous year[; provided that
 
16           in setting the allocation, the auditor shall explicitly
 
17           consider the advice of the superintendent and indicate
 
18           in the final determination the manner in which that
 
19           advice was accomodated];

 1      (2)  Small schools shall be given a state subsidy or small
 
 2           school allotment to augment the per pupil allocation
 
 3           given; provided that if additional federal grant moneys
 
 4           are received, the [auditor] superintendent shall
 
 5           determine the appropriate portion of the federal grant
 
 6           moneys to be used to offset the small school allotment;
 
 7           provided further that the federal grant moneys shall
 
 8           not include federal impact aid;
 
 9      (3)  The [auditor] superintendent shall take into
 
10           consideration any changes to the department's budget by
 
11           the legislature and any applicable collective
 
12           bargaining negotiated amounts; and
 
13      (4)  The allocation for self-contained special education
 
14           students and for other special education students shall
 
15           be adjusted appropriately to reflect the additional
 
16           expenses incurred for students in these programs;
 
17           provided that any increment to the per pupil allocation
 
18           made in this paragraph shall not exceed that available
 
19           to other public schools."
 
20      SECTION 3.  Statutory material to be repealed is bracketed.
