                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that crime prevention
 
 2 through environmental design standards (EDS) can lead to a
 
 3 reduction in the fear and incidences of crime and improvement in
 
 4 the quality of life by incorporating innovative solutions to
 
 5 address vandalism and other crime security problems.  The
 
 6 standards are used by architects, planners, and designers in the
 
 7 initial planning stages of development projects to prevent or
 
 8 reduce incidences of crime to and on property.
 
 9      The purpose of this Act is to require the department of
 
10 accounting and general services to incorporate crime prevention
 
11 through EDS to all new and renovated buildings of the public
 
12 school and library systems effective July 1, 2000.
 
13      SECTION 2.  Chapter 103, Hawaii Revised Statutes, is amended
 
14 by adding a new section to be appropriately designated and to
 
15 read as follows:
 
16      "�103-    Building criteria; public school and library
 
17 systems.  (a)  Crime prevention through environmental design
 
18 standards shall be incorporated by the department of accounting
 
19 and general services.  The standards shall apply to all new and
 
20 renovated buildings of the public school and library systems
 
21 effective July 1, 2000.

 1      (b)  Crime prevention through environmental design standards
 
 2 shall be based on the following strategies:
 
 3      (1)  Surveillance to keep offenders under observation, such
 
 4           as police (organized surveillance), lighting
 
 5           (mechanical surveillance), and windows (natural
 
 6           surveillance;
 
 7      (2)  Access control to deny access to a crime target and to
 
 8           create a perception of risk in offenders, such as
 
 9           guards (organized access control), locks (mechanical
 
10           access control), and spacial definition (natural
 
11           surveillance); and
 
12      (3)  Territoriality to create or extend a sphere of
 
13           territorial influence to offenders, such as low walls,
 
14           landscaping, and paving patterns.
 
15      (c)  As used in this section, "crime prevention through
 
16 environmental design standards" means standards that are used by
 
17 architects, planners, and designers in the initial planning
 
18 stages of development projects to prevent or reduce incidences of
 
19 crime to and on property.
 
20      (d)  The department of accounting and general services shall
 
21 establish rules under chapter 91 for the purpose of this

 1      SECTION 3.  New statutory material is underscored.
 
 2      SECTION 4.  This Act shall take effect upon its approval.
