                     A BILL FOR AN ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that organized high school
 
 2 athletics programs offer an opportunity for students to
 
 3 experience cooperative and interactive learning, and quality
 
 4 adult mentoring, as well as the opportunity to participate in
 
 5 supervised physical fitness and exercise programs.  Participating
 
 6 in sports, however, can sometimes result in injuries.  During the
 
 7 1998-1999 school year, of the seven thousand seven hundred
 
 8 eighty-one student athletes at twenty-one Oahu public schools,
 
 9 six thousand six hundred thirty-three injuries were reported.
 
10 Although studies show that the benefits derived from high school
 
11 athletics far outweigh the risk of injury, the legislature finds
 
12 that not enough is being done to reduce those risks.
 
13      With proper training and conditioning to prevent athletic
 
14 injuries and the prompt attention and care to injuries that do
 
15 occur, the benefits and rewards of high school athletics will be
 
16 enhanced and improved.  As reported in The Journal of Athletic
 
17 Training, "when high school athletes have access to qualified
 
18 athletic trainers and facilities, injury recovery time is rapid
 
19 and remarkable."

 1      The purpose of this Act is to reduce the risk of injury to
 
 2 high school athletes:
 
 3      (1)  Through preventive training and appropriate injury care
 
 4           by appropriating funds for athletic training equipment
 
 5           and supplies; and
 
 6      (2)  By requiring that funding of athletic programs,
 
 7           including athletic trainers, coaches, equipment and
 
 8           supplies, and transportation of teams be considered
 
 9           standard workload increase items in the planning and
 
10           budgeting of new schools.
 
11      SECTION 2.  Chapter 37, Hawaii Revised Statutes, is amended
 
12 by adding a new section to part IV to be appropriately designated
 
13 and to read as follows:
 
14      "�37-     Budgeting for new schools.  (a)  Funding for
 
15 coaches' salaries, athletic health care trainers' salaries,
 
16 athletic equipment and supplies, and the transportation of
 
17 athletic teams may be considered standard workload increase items
 
18 when planning and budgeting for new public schools.
 
19      (b)  The director of finance shall consult with the
 
20 superintendent of education to carry out the purposes of this
 
21 section."
 
22      SECTION 3.  Section 37-71, Hawaii Revised Statutes, is
 
23 amended by amending subsection (e) to read as follows:

 1      "(e)  The proposed budget shall include:
 
 2      (1)  A statement of the percentage differences between the
 
 3           current biennium recommendations and the previous
 
 4           biennium appropriations for education programs.  The
 
 5           information shall be displayed by programs or groups of
 
 6           programs, with corresponding amounts and percentage
 
 7           differences.  If any component of an education program
 
 8           is added or removed, the governor shall provide an
 
 9           estimate of how the addition or removal affects the
 
10           current biennium recommendations;
 
11      (2)  A statement of the difference between the total amount
 
12           proposed for the current biennium and the total amount
 
13           expended in the previous biennium for education
 
14           programs per pupil; and
 
15      (3)  Other financial statements, information, and data that
 
16           in the opinion of the governor are necessary or
 
17           desirable in order to make known in all practical
 
18           detail the programs, program plans, and financial
 
19           conditions of the State.
 
20      As used in this subsection, the term "education programs"
 
21 [include] includes instructional, personnel, transportation,
 
22 facilities, facilities repair and maintenance, and other programs
 
23 deemed appropriate by the department of education.  The term also
 
24 includes coaches' salaries, athletic health care trainers'

 1 salaries, athletic equipment and supplies, and the transportation
 
 2 of athletic teams for new public schools."
 
 3      SECTION 4.  There is appropriated out of the general
 
 4 revenues of the State of Hawaii the sum of $         or so much
 
 5 thereof as may be necessary for fiscal year 2000-2001 for high
 
 6 school athletic training equipment and supplies.
 
 7      The sum appropriated shall be expended by the department of
 
 8 education for the purposes of this Act.
 
 9      SECTION 5. This Act shall take effect on July 1, 2000.
