                   A  BILL  FOR  AN  ACT

RELATING TO THE UNIVERSITY OF HAWAII. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  All rights, powers, functions, and duties of the
 
 2 Institute for Astronomy at the University of Hawaii at Manoa are
 
 3 transferred to the University of Hawaii at Hilo.
 
 4      All officers and employees whose functions are transferred
 
 5 by this Act shall be transferred with their functions and shall
 
 6 continue to perform their regular duties upon their transfer,
 
 7 subject to the state personnel laws and this Act.
 
 8      No officer or employee of the State having tenure shall
 
 9 suffer any loss of salary, seniority, prior service credit,
 
10 vacation, sick leave, or other employee benefit or privilege as a
 
11 consequence of this Act and such officer or employee may be
 
12 transferred or appointed to a civil service position without the
 
13 necessity of examination; provided that the officer or employee
 
14 possesses the minimum qualifications for the position to which
 
15 transferred or appointed; and provided that subsequent changes in
 
16 status may be made pursuant to applicable civil service and
 
17 compensation laws.
 
18      An officer or employee of the State who does not have tenure
 
19 and who may be transferred or appointed to a civil service

 1 position as a consequence of this Act shall become a civil
 
 2 service employee without the loss of salary, seniority, prior
 
 3 service credit, vacation, sick leave, or other employee benefits
 
 4 or privileges and without the necessity of examination; provided
 
 5 that such officer or employee possesses the minimum
 
 6 qualifications for the position to which transferred or
 
 7 appointed.
 
 8      In the event that an office or position held by an officer
 
 9 or employee having tenure is abolished, the officer or employee
 
10 shall not thereby be separated from public employment, but shall
 
11 remain in the employment of the State with the same pay and
 
12 classification and shall be transferred to some other office or
 
13 position for which the officer or employee is eligible under the
 
14 personnel laws of the State as determined by the head of the
 
15 department or the governor.
 
16      SECTION 2.  All appropriations, records, equipment,
 
17 machines, files, supplies, contracts, books, papers, documents,
 
18 maps, and other property heretofore made, used, acquired, or held
 
19 by the Institute for Astronomy relating to the functions
 
20 transferred to the University of Hawaii at Hilo by this Act shall
 
21 be transferred with the functions to which they relate.

 1      SECTION 3.  All deeds, leases, contracts, loans, agreements,
 
 2 permits, or other documents executed or entered into by or on
 
 3 behalf of the Institute for Astronomy at the University of Hawaii
 
 4 at Manoa pursuant to the provisions fo the Hawaii Revised
 
 5 Statues, which are reenacted or made applicable to the Institute
 
 6 for Astronomy at the University of Hawaii at Hilo by this Act,
 
 7 shall remain in full force and effect.  Effective July 1, 2001,
 
 8 every reference to the Institute for Astronomy therein shall be
 
 9 construed as a reference to the Institute for Astronomy at the
 
10 University of Hawaii at Hilo.
 
11      SECTION 4.  It is the intent of this Act not to jeopardize
 
12 the receipt of any federal aid nor to impair the obligation of
 
13 the State or any agency thereof to the holder of any bond issued
 
14 by the Sate or by such agency, and to the extent, and only to the
 
15 extent, necessary to effectuate this intent, the governor may
 
16 modify the strict provisions of this Act, but shall promptly
 
17 report any such modifications with reasons therefor to the
 
18 legislature at its next session thereafter for review by the
 
19 legislature.
 
20      SECTION 5.  No later than ten days following the effective
 
21 date of this Act, the Institute for Astronomy, through the
 
22 University of Hawaii, shall develop a two-year plan to effectuate

 1 the transfer of the Institute for Astronomy from the University
 
 2 of Hawaii at Manoa to the University of Hawaii at Hilo.  The plan
 
 3 shall outline the transfer of items under this Act.  The
 
 4 University of Hawaii shall submit the plan to the legislature no
 
 5 later than twenty days before the regular session of 2000.  The
 
 6 actual transfer of the Institute for Astronomy shall be completed
 
 7 by July 1, 2001.
 
 8      SECTION 6.  This Act shall take effect on July 1, 1999.
