redevelopment commission to assist in the establishment of
airport support facilities at Barber's Point for use as in

                   A  BILL  FOR  AN  ACT

RELATING TO THE REDEVELOPMENT OF BARBERS POINT NAVAL AIR STATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the existing airport
 
 2 in Barbers Point creates a significant economic opportunity for
 
 3 the state.  Abandoned military airports, like the Barbers Point
 
 4 Naval Air Station, have been modified in the Philippines to be
 
 5 used as a commercial hub for manufacturing and distributing goods
 
 6 throughout the world.  The Philippines has seen great economic
 
 7 growth as a result.  The legislature further finds that use of
 
 8 the Barbers Point airport as a limited landing and take off
 
 9 facility instead of general aviation would reduce air traffic in
 
10 the area. 
 
11      The purpose of this Act is to provide economic opportunities
 
12 in the west Oahu area
 
13      SECTION 2.  Chapter 206G, Hawaii Revised Statutes, is
 
14 amended by adding four new sections to be appropriately
 
15 designated and to read as follows:
 
16      "�206G-       Kalaeloa airport support facilities.   The
 
17 commission shall identify real property that is suitable for use
 
18 as airport support facilities including but not limited to a
 
19 refueling depot and a distribution center for the import, export,
 
20 and warehousing of goods.

 1      �206G-     Independent construction of support facilities.
 
 2 (a)  All construction designs and architectural plans for support
 
 3 facilities shall be approved by the department of transportation
 
 4 before construction may commence.
 
 5      (b)  All costs related to the design, planning,
 
 6 construction, maintenance, and security of structures and grounds
 
 7 leased for support facilities shall be borne by the lessee.
 
 8      �206G-     Construction of support facilities; exemption
 
 9 from taxation.  All goods or services purchased for the design or
 
10 construction of support facilities shall be exempt from state
 
11 general excise taxes until the facilities are operational.
 
12      �206G-    Reduction in lease rents.   Upon any support
 
13 facility becoming operational, the lessor shall reduce lease
 
14 rents in the amounts as follows:
 
15      (1)  For the first three years that a support facility is in
 
16           continuous operation, lease rents shall be waived;
 
17      (2)  For the fourth and fifth year that a support facility
 
18           is in continuous operation, the lessees' lease rents
 
19           shall be twenty-five per cent of negotiated lease
 
20           rents;
 
21      (3)  For the sixth and seventh year that a support facility
 
22           is in continuous operation, the lessees' lease rents
 
23           shall be fifty per cent of negotiated lease rents;

 1      (4)  For the eighth and ninth year that a support facility
 
 2           is in continuous operation, the lessees' lease rents
 
 3           shall be seventy-five per cent of negotiated lease
 
 4           rents;
 
 5      (5)  For the tenth year that a support facility is in
 
 6           continuous operation, the lessees' lease rents shall be
 
 7           ninety-five per cent of negotiated lease rents; and
 
 8      (6)  For all subsequent years, the lessee shall be
 
 9           responsible for its full lease rents under its contract
 
10           with the lessor."
 
11      SECTION 3.  Section 206G-2, Hawaii Revised Statutes, is
 
12 amended by adding a new definition to be appropriately inserted
 
13 and to read as follows:
 
14      ""Support facility" means any improvement to land, including
 
15 above or underground structures, storage tanks, roads maintenance
 
16 bays, hangers, or other related improvements necessary to
 
17 facilitate the import, export, or warehousing of goods for sale
 
18 in the State or abroad."
 
19      SECTION 4.  New statutory material is underscored.
 
20      SECTION 5.  This Act shall take effect upon its approval.
