                   A  BILL  FOR  AN  ACT

RELATING TO REALLOCATION OF VACANT LIBRARY POSITIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The Legislature finds that the public library
 
 2 system has effectively served the general public in various
 
 3 geographic locations of the State of Hawaii with responsible and
 
 4 efficient allocation of human resources as the need occurs.
 
 5      In 1996, the Legislature by Act 196, Session Laws of Hawaii
 
 6 1996, granted the State Librarian the temporary power to
 
 7 reallocate vacant positions and to create temporary positions,
 
 8 not to exceed one year, throughout the public library system.  As
 
 9 public library system employees retire, transfer to other
 
10 departments and agencies, and leave the state service and
 
11 position vacancies occur at various work locations, the State
 
12 Librarian, under Act 196, Session Laws of Hawaii 1996, has the
 
13 authority to reallocate these vacant positions to other state
 
14 libraries.  When no vacant positions are available, the State
 
15 Librarian can establish temporary positions of not more than one
 
16 year to meet library staffing needs.  The application of this
 
17 authority has been successful in meeting the public service and
 
18 staffing needs of HSPLS libraries.  This authority has also
 
19 helped support employee satisfaction at urban, rural, remote, and

 1 new libraries.
 
 2      The purpose of this Act is to extend the State Librarian's
 
 3 temporary authority under Act 196, Session Laws of Hawaii 1996,
 
 4 to reallocate vacant positions and to establish temporary
 
 5 positions of not more than one year.  This authority is still
 
 6 needed to provide for public library services at the right time
 
 7 and in the right place during the complex, time-consuming
 
 8 reorganization efforts currently underway.
 
 9      SECTION 2.  Act 196, Session Laws of Hawaii 1996, is amended
 
10 by amending section 3 to read as follows:
 
11      "SECTION 3.  This Act shall take effect upon its approval
 
12 and shall be repealed on June 30, [1999.] 2002."
 
13      SECTION 3.  Statutory material to be repealed is bracketed.
 
14 New statutory material is underscored.
 
15      SECTION 4.  This Act shall take effect on June 29, 1999.
