REPORT TITLE:
Health Fund


DESCRIPTION:
Exempts the Public Employees Health Fund Administrator
(Administrator) from state civil service laws.  Specifies that
the Administrator's salary be within the range established for
departmental deputy directors.  Allows the Administrator to
become a member of the State Employees' Retirement System and

                   A  BILL  FOR  AN  ACT

RELATING TO THE PUBLIC EMPLOYEES HEALTH FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 87-28, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�87-28  Other powers.  In addition to the power to
 
 4 administer the fund, the board of trustees may:
 
 5      (1)  Collect, receive, deposit, withdraw, and invest money
 
 6           in behalf of the fund;
 
 7      (2)  Appoint [an]:
 
 8           (A)  An administrator, who shall be exempt from
 
 9                chapters 76 and 77 and serve under and at the
 
10                pleasure of the board; and [staff]
 
11           (B)  Staff, subject to chapters 76 and 77 and section
 
12                78-1, necessary to carry out this chapter[,];
 
13           who shall be subject to the limitations of available
 
14           appropriations [and chapters 76 and 77 and section
 
15           78-1];
 
16      (3)  Effective January 1, 2000, set the salary of the
 
17           administrator within the range established for deputy
 
18           directors.  The administrator shall be a member of the
 
19           state employees' retirement system and shall be

 1           eligible to receive the benefits of any state or
 
 2           federal employee benefit program generally applicable
 
 3           to officers and employees of the State;
 
 4     [(3)] (4)  Make payments of periodic charges and pay for
 
 5           reasonable expenses incurred to carry out the purposes
 
 6           of the fund; or
 
 7     [(4)] (5)  Require any department, agency, or employee of the
 
 8           State and county to furnish information to the board to
 
 9           carry out the purposes of this chapter."
 
10      SECTION 2.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 3.  This Act shall take effect upon its approval.
