                   A  BILL  FOR  AN  ACT

RELATING TO THE COMMISSION ON THE STATUS OF WOMEN.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 367, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "367-    Commission on the status of women trust fund.  (a)
 
 5 There is established a commission on the status of women trust
 
 6 fund.  All funds contributed to the trust fund, including income
 
 7 and capital gains earned therefrom, shall be used exclusively for
 
 8 commission programs as defined in the articles, bylaws,
 
 9 resolutions, and other instruments executed on behalf of the
 
10 commission on the status of women or any nonprofit organization
 
11 established thereunder.  The trust fund may receive any and all
 
12 types of private contributions, and the income and capital gains
 
13 earned by the fund; provided that funds or properties donated for
 
14 the commission's use shall be deposited and accounted for in
 
15 accordance with policies and procedures adopted by the
 
16 comptroller.  The trust fund shall be subject to the following
 
17 restrictions:
 
18      (1)  All funds, and the income and capital gains earned by
 
19           investment of those funds, shall be expended only for

 1           the support of the commission or its nonprofit
 
 2           organization's programs; and
 
 3      (2)  Other restrictions imposed by the legislature with
 
 4           respect to the transfer or appropriation of funds.
 
 5      (b)  Any funds deposited in the trust fund, and any income
 
 6 and capital gains earned therefrom, not used for the commission
 
 7 or its nonprofit organization's programs, shall be invested in
 
 8 accordance with the provisions of the articles, bylaws,
 
 9 resolutions, or other instruments executed on behalf of the
 
10 commission or its nonprofit organization, and in a manner
 
11 intended to maximize the rate of return on investment of the
 
12 fund.
 
13      (c)  If the trust fund is terminated or the commission or
 
14 its nonprofit organization is dissolved, all funds, including the
 
15 income and capital gains earned by the investment of funds, shall
 
16 be distributed in accordance with the articles and bylaws of the
 
17 commission or its nonprofit organization.
 
18      (d)  The commission shall require an annual audit of the
 
19 trust fund, the results of which shall be submitted to the
 
20 department of budget and finance not more than thirty days after
 
21 receipt by the commission.  The commission shall retain for a
 
22 period of three years, any documents, papers, books, records, and
 
23 other evidence that are pertinent to the trust fund, and permit

 1 inspection or access thereto by the department of budget and
 
 2 finance, the department of accounting and general services, state
 
 3 legislators, and the auditor, or their duly authorized
 
 4 representatives.
 
 5      (e)  The trust fund shall be subject to the terms and
 
 6 conditions provided in this section.  The trust fund shall not be
 
 7 placed in the state treasury and the State shall not administer
 
 8 the fund nor be liable for its operation or solvency.  The fund
 
 9 shall be a private charitable trust fund administered by a
 
10 private trust company as trustee.
 
11      (f)  Subsections (a) to (e) shall take effect upon the
 
12 creation of a commission on the status of women foundation, a
 
13 tax-exempt, nonprofit foundation that is subject to the terms and
 
14 conditions provided in this section."
 
15      SECTION 2.  Section 367-1, Hawaii Revised Statutes, is
 
16 amended to read as follows:
 
17      "[[]367-1[]]  Findings and purpose.  The legislature finds
 
18 that the work of the [governor's] state commission on the status
 
19 of women, established by the governor by executive order on
 
20 May 15, 1964, demonstrates the need for a continuing body to aid
 
21 in the implementation of its recommendations, to develop long-
 
22 range goals, and to coordinate research planning, programming,
 
23 and action on the opportunities, needs, problems, and

 1 contributions of women in Hawaii [in (1) education, (2)
 
 2 homemaking, (3) civil and legal rights, (4) labor and employment,
 
 3 and (5) expanded community horizons].  It is the purpose of this
 
 4 chapter to provide for a statewide program, on a permanent and
 
 5 continuing basis, on the status of women in Hawaii."
 
 6      SECTION 3.  Section 367-3, Hawaii Revised Statutes, is
 
 7 amended to read as follows:
 
 8      "367-3  [Duties] Powers and duties of commission.  The
 
 9 commission shall:
 
10      (1)  Act as a central clearinghouse and coordinating body
 
11           for governmental and nongovernmental activities and
 
12           information relating to the status of women;
 
13     [(2)  Accumulate, compile, and publish information concerning
 
14           instances of actual discrimination, and discrimination
 
15           in the law, against women;
 
16      (3)  Cooperate with the department of labor and industrial
 
17           relations and other state departments and agencies and
 
18           appropriate federal offices and agencies in correcting
 
19           unlawful employment practices, in public and private
 
20           employment, involving discrimination because of sex;
 
21      (4)] (2)  Create public awareness and understanding of the
 
22           responsibilities, needs, potentials, and contributions
 
23           of women [as homemakers, workers, and active

 1           participants in community life and of the importance of
 
 2           each of these] and their roles in the changing society;
 
 3     [(5)] (3)  Recommend legislative and administrative action on
 
 4           equal treatment and opportunities for women;
 
 5     [(6)  Seek improvements in educational and counseling
 
 6           programs and policies to meet the needs of girls and
 
 7           women in order better to prepare them for their roles
 
 8           in the home and community;
 
 9      (7)] (4)  Encourage a long-range program of education of
 
10           women in their political rights and responsibilities,
 
11           particularly with respect to their voting duties;
 
12     [(8)] (5)  Maintain contacts with appropriate federal, state,
 
13           local, and international agencies concerned with the
 
14           status of women;
 
15     [(9)] (6)  Cooperate and collaborate with national groups on
 
16           the status of women and arrange for participation by
 
17           representatives of the State in White House conferences
 
18           and other national conferences from time to time;
 
19    [(10)] (7)  Administer funds allocated for its work; be
 
20           authorized to accept, disburse, and allocate funds
 
21           [which] that may become available from other
 
22           governmental and private sources; provided that all
 
23           such funds shall be disbursed or allocated in
 
24           compliance with any specific designation stated by the

 1           donor and in the absence of such specific designation,
 
 2           such funds shall be disbursed or allocated on projects
 
 3           related to any of the purposes of this chapter; and
 
 4    [(11)] (8)  Submit an annual report with recommendations to
 
 5           the governor and the legislature."
 
 6      SECTION 4.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 5.  This Act shall take effect upon its approval.
