Legislative Agencies


DESCRIPTION:
Appropriates funds to grant retroactive pay adjustments for
legislative agency employees.  Corrects a drafting error in Act
138-1999 which required the lapsing of funds within the fiscal
year for which it was appropriated--hence the appropriation for
fiscal year 1998-1999 were precluded by an effective date of
July 1, 1999.  The appropriation is necessary to allow these
employees to maintain parity with other state employees and is
based on a settlement for a 2-year collectively bargained
agreement with the exclusive representative of bargaining units

                   A  BILL  FOR  AN  ACT

MAKING AN APPROPRIATION TO THE LEGISLATIVE AGENCIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act corrects a technical drafting error in
 
 2 Act 138, Session laws of Hawaii 1999.  Act 138 appropriated funds
 
 3 to the legislative agencies for salary increases and other cost
 
 4 adjustments authorized by chapter 89C, Hawaii Revised Statutes,
 
 5 for officers and employees of these agencies excluded from
 
 6 collective bargaining.
 
 7      The appropriations under Act 138 were for fiscal years 1998-
 
 8 1999, 1999-2000, and 2000-2001.  Since Act 138 required the
 
 9 lapsing of funds within the fiscal year it was appropriated, the
 
10 Act's effective date of July 1, 1999 precluded the expenditure of
 
11 the 1998-1999 appropriations, which included adjustments
 
12 commencing January 1, 1998.  This Act corrects this inadvertent
 
13 error.
 
14      This Act is also necessary to maintain parity with other
 
15 state employees and is based on a settlement for a two-year
 
16 collectively bargained agreement with the exclusive
 
17 representative of bargaining units 3, 4, and 13.
 
18      SECTION 2.  There is appropriated out of the general
 
19 revenues of the State of Hawaii to the legislative agencies

 1 indicated below the following sums or so much thereof as may be
 
 2 necessary, to fund the retroactive salary increases and other
 
 3 cost adjustments for fiscal year 1998-1999, which includes cost
 
 4 adjustments commencing January 1, 1998, authorized by chapter
 
 5 89C, Hawaii Revised Statutes, for officers and employees of these
 
 6 agencies excluded from collective bargaining:
 
 7      Office of the Auditor                           $65,633
 
 8      Ethics Commission                                22,644
 
 9      Legislative Reference Bureau                     79,512
 
10      Ombudsman                                        34,321
 
11      SECTION 3.  Funds appropriated by this Act that are not
 
12 expended or encumbered by June 30, 2001, shall lapse as of that
 
13 date.  The sums appropriated shall be expended by the respective
 
14 heads of the legislative agencies for the purposes of this Act.
 
15      SECTION 4.  This Act shall take effect upon its approval.
