REPORT TITLE:
Educational Accountability


DESCRIPTION:
Requires the DOE to implement the educational accountability
system for Hawaii's public schools.  Requires DOE to develop a
collaborative process with stakeholders, including
representatives of affected bargaining units, parents,
administration, and students.  Limits chapter 89, HRS,
negotiations to the impact on personnel arising from the
superintendent's implementation of the educational accountability

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATIONAL ACCOUNTABILITY.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1004, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "302A-1004  Educational [assessment and] accountability[;]
 
 4 system; annual reports.(a)  The department shall [establish]
 
 5 implement a comprehensive system of educational accountability to
 
 6 motivate and support the improved performance of students and the
 
 7 education system.  This accountability system shall:
 
 8      (1)  Include student accountability; school or collective
 
 9           professional accountability; individual professional
 
10           accountability for teachers, principals, and other
 
11           employees; and public accounting for other significant
 
12           partners to the education process (including, but not
 
13           limited to, parents, community members, businesses,
 
14           higher education, media, and political leadership);
 
15     [(1)] (2)  Link authority and adequate resources to
 
16           responsibility;
 
17     [(2)] (3)  Define clear roles for all parties and lines of
 
18           responsibility and mutual obligation[;] and develop a
 
19           collaborative process with stakeholders, including
 
20           representatives of appropriate bargaining units,

 1           parents, administration, and students;
 
 2     [(3)] (4)  Involve fair and adequate assessment against
 
 3           agreed upon goals;
 
 4     [(4)] (5)  Invoke a full and balanced set of appropriate
 
 5           [actions (assistance, rewards, or sanctions) for
 
 6           observed performance;] consequences for observed
 
 7           performance, including rewards and recognition for
 
 8           those schools that meet or exceed their goals,
 
 9           assistance to those that fall short, and sanctions for
 
10           those that given adequate assistance and ample time,
 
11           continue to fail to meet goals;
 
12     [(5)] (6)  Involve [a]:
 
13           (A)  A statewide student assessment program that [is
 
14                explicitly aligned with the Hawaii] provides
 
15                annual data on student, school, and system
 
16                performance at selected benchmark grade levels in
 
17                terms of student performance relative to statewide
 
18                content and performance standards and embodies
 
19                high and rigorous expectations for the attainment
 
20                of all students; and
 
21           (B)  An annual assessment in core subjects for each
 
22                grade level, as conducted by each school;
 
23     [(6)] (7)  Involve a comprehensive school profile or report

 1           card for each school, which shall include, but not be
 
 2           limited to, student performance measures, school
 
 3           attendance, drop-out rates, and parental involvement.
 
 4           These reports shall be made available annually to the
 
 5           board, the governor, the legislature, the parents, and
 
 6           the general public[.];
 
 7      (8)  Require that teachers and administrators engage in the
 
 8           continuous professional growth and development that
 
 9           ensure their currency with respect to disciplinary
 
10           content, leadership skill, knowledge, or pedagogical
 
11           skill, as appropriate to their position.  This
 
12           requirement may be established by the department in
 
13           terms of credit hours earned or their equivalent in
 
14           professional development activity certified by the
 
15           department as appropriate in focus and rigor; and
 
16      (9)  Establish an explicit link between professional
 
17           evaluation results and individual accountability
 
18           through professional development of the knowledge,
 
19           skill, and professional behavior necessary to the
 
20           position, by requiring that results of the professional
 
21           evaluation be used by the department to prescribe
 
22           professional development focus and content, as
 
23           appropriate.

 1      Beginning with the 2001-2002 school year, the department
 
 2 shall submit to the legislature, the governor, and the board of
 
 3 education at least twenty days prior to the convening of each
 
 4 regular legislative session a report of the specifics of the
 
 5 design of the comprehensive accountability system, as well as the
 
 6 fiscal requirements and legislative actions necessary to create
 
 7 the accountability system.
 
 8      (b)  The department shall submit to the legislature and to
 
 9 the governor, at least twenty days prior to the convening of each
 
10 regular legislative session, an educational status report that
 
11 includes but is not limited to the following:
 
12      (1)  Results of school-by-school assessments of educational
 
13           outcomes[, including reference to such student
 
14           performance standards and school-by-school assessment
 
15           models as may be developed by the commission on
 
16           performance standards and adopted by the board.  This
 
17           paragraph is repealed on June 30, 2001];
 
18      (2)  Summaries of [school improvement plans;] each school's
 
19           standards implementation design;
 
20      (3)  Summary descriptions of the demographic makeup of the
 
21           schools, with indications of the range of these
 
22           conditions among schools within Hawaii;
 
23      (4)  Comparisons of conditions affecting Hawaii's schools

 1           with the conditions of schools in other states; and
 
 2      (5)  Other such assessments as may be deemed appropriate by
 
 3           the board.
 
 4      (c)  The department shall provide electronic access to
 
 5 computer-based financial management, student information, and
 
 6 other information systems to the legislature and the auditor.
 
 7 The department shall submit to the legislature and to the
 
 8 governor, at least twenty days prior to the convening of each
 
 9 legislative session, a school-by-school expenditure report that
 
10 includes but is not limited to the following:
 
11      (1)  The financial analysis of expenditures by the
 
12           department with respect to the following areas:
 
13           (A)  Instruction, including face-to-face teaching, and
 
14                classroom materials;
 
15           (B)  Instructional support, including pupil, teacher,
 
16                and program support;
 
17           (C)  Operations, including non-instructional pupil
 
18                services, facilities, and business services;
 
19           (D)  Other commitments, including contingencies,
 
20                capitol improvement projects, out-of-district
 
21                obligations, and legal obligations; and
 
22           (E)  Leadership, including school management, program
 
23                and operations management, and district

 1                management; and
 
 2      (2)  The measures of accuracy, efficiency, and productivity
 
 3           of the department, districts, and schools in delivering
 
 4           resources to the classroom and the student.
 
 5      (d)  The superintendent of education is responsible for the
 
 6 development and implementation of an educational accountability
 
 7 system.  The system shall include consequences and shall be
 
 8 designed through a collaborative process involving stakeholders
 
 9 that shall include parents, community members, the respective
 
10 exclusive representatives, as well as others deemed appropriate
 
11 by the superintendent.
 
12      For the purposes of this section, negotiations under chapter
 
13 89 shall be between the superintendent or the superintendent's
 
14 designee and the respective exclusive representative, and shall
 
15 be limited to the impact on personnel arising from the
 
16 superintendent's decision in implementing the educational
 
17 accountability system.  After the initial agreement is
 
18 negotiated, provisions on the impact of the accountability on
 
19 personnel may be reopened only upon mutual agreement of the
 
20 parties."
 
21      SECTION 2.  Act 74, Session Laws of Hawaii 1999, is amended
 
22 by amending section 3 to read as follows:
 
23      "SECTION 3.  The department of education shall submit a

 1 report on [the findings and recommendations of the design of the
 
 2 comprehensive accountability system referred to in section 2 of
 
 3 this Act, to the legislature, and to the governor, at least
 
 4 twenty days prior to the convening of the regular legislative
 
 5 session of 2000.  This report shall include, but not be limited
 
 6 to, the essential elements of the design, a timeline for its
 
 7 implementation, the legislative actions necessary to enable
 
 8 implementation, as well as a fiscal note describing resources
 
 9 necessary to execute the designs.  The department of education
 
10 shall submit a report on] the status of the implementation of the
 
11 [comprehensive] educational accountability system to the
 
12 legislature, and to the governor, at least twenty days prior to
 
13 the convening of the regular legislative session of 2001."
 
14      SECTION 3.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 4.  This Act shall take effect upon its approval.
