     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred S.B. No. 591, S.D. 1, entitled: 


begs leave to report as follows:

     The purpose of this bill is to require a court to find that
a child's physical safety and psychological well-being will be
protected, prior to ordering visitation regarding that child.

     Testimony in support of this bill was received from Child &
Family Service, Hawaii State Coalition Against Domestic Violence,
and the Domestic Violence Clearinghouse.

     Your Committee finds that evidence of domestic violence
should be considered in the determination of child custody and/or
visitation awards. 

     Your Committee has amended this bill by making technical,
nonsubstantive amendments for purposes of clarity and style.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of S.B. No. 591, S.D. 1, as amended herein, and
recommends that it pass Second Reading in the form attached
hereto as S.B. No. 591, S.D. 1, H.D. 1, and be placed on the
calendar for Third Reading.
