                                   RE: S.B. No. 1088
                                        S.D. 1

Honorable Norman Mizuguchi
President of the Senate
Twentieth State Legislature
Regular Session of 1999
State of Hawaii

Your Committee on Economic Development, to which was
referred S.B. No. 1088 entitled:

begs leave to report as follows:
The purpose of this measure is to establish procedures for
the seizure, forfeiture, and disposal of natural resources

Your Committee received testimony in support of this measure
from the Department of Land and Natural Resources and the
Environmental Center of the University of Hawaii. Boat Owners

Your Committee finds that this measure authorizes the
department to sell perishable natural resources that are seized
in order to prevent waste and to ensure the economic value of the
natural resource. This would relieve the State of the time and
expense of storing a commodity that declines rapidly in value
with storage, and limit the State's liability for loss of value
if it is later determined that the seizure was unlawful.

Your Committee is in support of this measure and has amended
it to delete the first two sentences of the proposed new language
in Section 199-7, Hawaii Revised Statutes, regarding forfeiture
of any seized item, other than a natural resource. Technical,
nonsubstantive amendments were also made.
