Sir:

     Your Committee on Higher Education, to which was referred
H.B. No. 248 entitled: 

     "A BILL FOR AN ACT RELATING TO THE UNIVERSITY OF HAWAII,"

begs leave to report as follows:

     The purpose of this bill is to clarify that the Attorney
General may provide legal representation to the University of
Hawaii to the same extent that such services are available to any
other State department. 

     Testimony in support of the bill was received from the
University of Hawaii and Dawson International, Inc.  

     Your Committee finds that the "UH Autonomy/Flexibity Act,"
Act 115, Session Laws of Hawaii 1998, which authorized the
University to retain its own legal counsel, contains language
which has been interpreted to preclude the Department of the
Attorney General from providing legal services to the University.
This bill clarifies that it was not intended that the Department
of the Attorney General be prohibited from rendering legal
service to the university.

     As affirmed by the record of votes of the members of your
Committee on Higher Education that is attached to this report,
your Committee is in accord with the intent and purpose of H.B.
No. 248 and recommends that it pass Second Reading and be
referred to the Committee on Finance.
