Sir:

     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred H.B. No. 212 entitled: 

     "A BILL FOR AN ACT RELATING TO DRIVING UNDER THE INFLUENCE
     OF INTOXICATING LIQUOR,"

begs leave to report as follows:

     The purpose of this bill is to discourage driving under the
influence of alcohol while having passengers who are minors in
the automobile.

     Your Committee received testimony in support of this bill
from the Department of Transportation, the Department of the
Prosecuting Attorney for the County of Maui, Mothers Against
Drunk Driving, Keiki Injury Prevention Coalition, and concerned
individuals.  The Office of the Public Defender submitted
comments on this measure.  

     Your Committee finds that the creation of sanctions against
adults who drive drunk and endanger minors who are their
passengers would promote driver awareness of their responsibility
to passengers.

     Although this measure could adversely affect situations
involving a group of friends in about the same age group, the
intent of your Committee in approving the measure is to address
those situations in which adult drivers, because of their
intoxication, may be recklessly placing infants, toddlers, and
very young children in peril.

     Your Committee amended this bill by clarifying that the
sanctions apply only to adult drivers.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 212, as amended herein, and recommends that
it pass Third Reading in the form attached hereto as H.B. No.
212, H.D. 1.
