STAND. COM. REP. NO. 867

                                 Honolulu, Hawaii

                                 RE: H.B. No. 19

Honorable Calvin K.Y. Say
Speaker, House of Representatives
Twentieth State Legislature
Regular Session of 1999
State of Hawaii

Sir:

Your Committees on Consumer Protection and Commerce and
Judiciary and Hawaiian Affairs, to which was referred H.B. No. 19
entitled:

"A BILL FOR AN ACT RELATING TO LIQUOR LICENSES,"

beg leave to report as follows:

The purpose of this bill is to add assault to the factors
that the liquor commission may consider in revoking, suspending
or placing conditions or restrictions on liquor licenses.

Testimony in support of this bill was received from the
Downtown Neighborhood Board No. 18, the Ala Moana/Kakaako
Neighborhood Board, the Urban Honolulu Crime Fax Network, and the
Honolulu Police Department (HPD). All testifiers indicated a
need for this bill to enable the liquor commission to exercise
better control over establishments serving liquor, in order to
minimize the negative impact on the surrounding communities.

Testimony from HPD and Downtown Neighborhood Board No. 18
indicated that assault is a type of criminal activity that is
very troublesome at some licensed venues, yet the liquor
commission does not consider assault to be a criminal activity it
can consider in denying renewal of licenses.

As affirmed by the records of votes of the members of your
Committees on Consumer Protection and Commerce and Judiciary and
Hawaiian Affairs that are attached to this report, your
Committees are in accord with the intent and purpose of H.B. No.

behalf of the members of the
                                   Committees on Consumer
                                   Protection and Commerce and
