                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING THE CHILD PROTECTION LEGISLATIVE ROUNDTABLE AND THE
    APPLESEED PUBLIC INTEREST LAW FOUNDATION TO EXAMINE AND
    DISCUSS SELECTED ISSUES RELATING TO CHILD ABUSE.



 1        WHEREAS, the Child Protection Legislative Roundtable (CPL
 2   Roundtable) is an ad hoc group of service providers and medical
 3   specialists in child protection; and
 4   
 5        WHEREAS, the CPL Roundtable has been instrumental in
 6   improving the Child Protective Services System, including the
 7   enactment of its recommendations in Act 134, Session Laws of
 8   Hawaii 1998; and
 9   
10        WHEREAS, the CPL Roundtable is continuing to meet and to
11   discuss issues relating to child protection, in the recognition
12   that the Child Protective Services System is not perfect and
13   that ongoing communication on a daily basis in detecting,
14   preventing, and treating child abuse benefits all participants
15   in their work; and
16   
17        WHEREAS, the Appleseed Public Interest Law Foundation
18   provides the kind of assistance necessary in reviewing,
19   analyzing, and making recommendations for statutory revisions
20   relating to child protection laws, and has already begun to do
21   so; and
22   
23        WHEREAS, although improvements in the Child Protective
24   Services System are continually being made, either formally
25   through statutory amendments or informally through
26   collaboration and cooperation among the parties involved in
27   child protection, there still remains specific issues that need
28   to be examined and may need legislation; now, therefore,
29   
30        BE IT RESOLVED by the Senate of the Twentieth Legislature
31   of the State of Hawaii, Regular Session of 1999, the House of
32   Representatives concurring, that the CPL Roundtable and the
33   Appleseed Public Interest Law Foundation are requested to
34   examine and discuss issues concerning:

 1        (1)  Recruitment and retainment of social workers in the
 2             Child Protective Services System, Department of Human
 3             Services;
 4   
 5        (2)  Expanding the criteria for reporting abuse cases;
 6   
 7        (3)  Amending section 702-235, Hawaii Revised Statutes
 8             (HRS), relating to ineffective consent for purposes
 9             of the Penal Code;
10   
11        (4)  Amending the procedures relating to out-of-family
12             abuse;
13   
14        (5)  Amending section 577-1, HRS, relating to the age of
15             majority;
16   
17        (6)  Evaluating the manner in which guardian ad litem
18             services are provided;
19   
20        (7)  Changing the licensing and training requirements for
21             specially licensed relative foster boarding homes;
22   
23        (8)  Examining incidences of child exploitation and their
24             relationship to child abuse and neglect; 
25   
26        (9)  Evaluating other circumstances that endanger the
27             welfare of a child in cases of criminal child abuse;
28             and
29   
30       (10)  Receiving and reviewing the findings and
31             recommendations of the comprehensive assessment of
32             state child protection statutes performed by the
33             Appleseed Public Interest Law Foundation;
34   
35   and
36   
37        BE IT FURTHER RESOLVED that the CPL Roundtable, with the
38   assistance of the Department of Human Services, report its
39   findings and recommendations to the Legislature no later than
40   twenty days prior to the convening of the Regular Session of
41   2000; and
42   
43        BE IT FURTHER RESOLVED that certified copies of this
44   Concurrent Resolution be transmitted to the CPL Roundtable and
45   the Director of Human Services.
