                    SENATE  CONCURRENT
                        RESOLUTION

  REQUESTING A REVIEW OF THE UNIFORM LAW COMMISSIONERS' MODEL
    STATE ADMINISTRATIVE PROCEDURE ACT OF 1981 AND CHAPTER 91,
    HAWAII REVISED STATUTES, IN THE INTERESTS OF STREAMLINING
    GOVERNMENT REGULATIONS.


 1        WHEREAS, Hawaii Administrative Rules currently include
 2   more than one thousand chapters and nearly thirty-four thousand
 3   sections; and
 4   
 5        WHEREAS, the Executive Branch has undertaken a
 6   streamlining effort to reduce the burden of government
 7   regulations by forty percent; and
 8   
 9        WHEREAS, this goal will be accomplished in part by
10   eliminating obsolete rules, reviewing rule-making procedures
11   and making rules more accessible to the public; and
12   
13        WHEREAS, each administrative department is currently
14   reviewing its rules to identify those that can be eliminated or
15   changed; and
16   
17        WHEREAS, public input will also be a major factor in
18   decisions to revise or eliminate burdensome rules; and
19   
20        WHEREAS, in addition to streamlining the rule-making
21   process, the Hawaii Administrative Procedure Act, Chapter 91,
22   Hawaii Revised Statutes (HRS), should be reviewed in its
23   entirety; and
24   
25        WHEREAS, this review should also include an examination of
26   the Uniform Law Commissioners' Model State Administrative
27   Procedure Act of 1981; now, therefore,
28   
29        BE IT RESOLVED by the Senate of the Twentieth Legislature
30   of the State of Hawaii, Regular Session of 1999, the House of
31   Representatives concurring, that the Executive Branch, as part
32   of its streamlining of government regulations, is requested to
33   review Chapter 91, HRS, and the Uniform Law Commissioners'
34   Model State Administrative Procedure Act of 1981, for

 1   consideration as a replacement for all or portions of
 2   Chapter 91, HRS; and
 3   
 4        BE IT FURTHER RESOLVED that the Executive Branch shall
 5   report to the Legislature twenty days prior to the Regular
 6   Session of 2000 on its findings and recommendations, including
 7   draft legislation if necessary; and
 8   
 9        BE IT FURTHER RESOLVED that a certified copy of this
10   Concurrent Resolution be transmitted to the Governor.
