                    SENATE  CONCURRENT
                        RESOLUTION

  ENCOURAGING THE DEPARTMENT OF AGRICULTURE TO CLAIM ITS FAIR
    SHARE OF THE CEDED LAND REVENUES.



 1        WHEREAS, section 5(f) of the Admission Act established the
 2   public land trust for five purposes:  the support of public
 3   schools, the betterment of conditions of native Hawaiians, for
 4   the development of farm and home ownership, the making of
 5   public improvements, and for the provision of lands for public
 6   use; and
 7   
 8        WHEREAS, the Admission Act clearly states that the use of
 9   ceded land revenues for any other purpose constitutes a breach
10   of trust, for which the State may be sued by the United States;
11   and
12   
13        WHEREAS, to date, ceded land moneys have not been directly
14   used for the development of farm and home ownership; and
15   
16        WHEREAS, the Office of Hawaiian Affairs, which is charged
17   with the betterment of native Hawaiians, receives one-fifth, or
18   twenty percent, of ceded land revenues; and
19   
20        WHEREAS, the Department of Agriculture should receive no
21   less for the development of farm ownership; now, therefore,
22   
23        BE IT RESOLVED by the Senate of the Twentieth Legislature
24   of the State of Hawaii, Regular Session of 1999, the House of
25   Representatives concurring, that the Department of Agriculture
26   is encouraged to present its claim to the Governor for direct
27   receipt of twenty percent of ceded land revenues for the
28   development of farm ownership; and
29   
30        BE IT FURTHER RESOLVED that it is the intent of the
31   Legislature that the Department of Agriculture pursue its fair
32   share of the ceded land claims; and
33   
34        BE IT FURTHER RESOLVED that certified copies of this
35   Concurrent Resolution be transmitted to the Chairperson of the
36   Board of Agriculture.
