                   A  BILL  FOR  AN  ACT

RELATING TO INCENTIVE PROGRAMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to affirm the State's
 
 2 commitment to providing efficient and effective services to the
 
 3 public by creating additional incentives within state government
 
 4 to encourage innovation and savings.
 
 5      SECTION 2.  Chapter 82, Hawaii Revised Statutes, is amended
 
 6 by adding a new section to be appropriately designated and to
 
 7 read as follows:
 
 8      "�82-    Department incentives.  (a)  Except as otherwise
 
 9 provided by law, any executive or administrative department that
 
10 implements cost-saving practices to reduce the executive or
 
11 administrative department's expenses, shall be authorized as
 
12 follows:
 
13      (1)  Fifty per cent of the realized savings shall lapse and
 
14           be returned to the general fund in the manner
 
15           prescribed in section 40-66; and
 
16      (2)  Fifty per cent of the remaining realized savings shall
 
17           be returned to the department employees in an even
 
18           distribution in amounts not less than $1 per employee
 
19           and not more than $1,000 per employee, in accordance

 1           with the department's public approval rating.
 
 2      (b)  The department of budget and finance shall select a
 
 3 private agency to conduct a biannual public opinion survey, in a
 
 4 manner to be determined by the private agency to establish a
 
 5 public approval rating of all executive and administrative
 
 6 departments upon which the return of funds would be based.
 
 7      (c)  As used in this section, "public approval" means the
 
 8 public's perception or opinion as to the efficiency and quality
 
 9 of service of the department or agency.
 
10      (d)  The director of each department shall adopt rules
 
11 pursuant to chapter 91 to implement this section."
 
12      SECTION 3.  The state auditor shall review the operations of
 
13 each department to examine its efficiency and the quality of
 
14 service provided to the public.  The auditor shall submit a
 
15 report to the legislature with its findings and recommendations
 
16 no later than twenty days prior to the convening of the 2000
 
17 regular session.
 
18      SECTION 4.  There is appropriated out of the general
 
19 revenues of the State of Hawaii the sum of $        , or so much
 
20 thereof as may be necessary for fiscal year 1999-2000, to carry
 
21 out the purposes of this Act.
 
22      SECTION 5.  The sum appropriated shall be expended by the
 
23 director of finance.

 1      SECTION 6.  New statutory material is underscored.
 
 2      SECTION 7.  This Act shall take effect on July 1, 1999.
