                   A  BILL  FOR  AN  ACT

RELATING TO BUSINESS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that existing law
 
 2 prohibits any business from discriminating against any person
 
 3 based on gender.  This Act specifically prohibits businesses from
 
 4 discriminating, with respect to the price charged for services of
 
 5 the same or similar nature, against a person based on gender.
 
 6 Further, this Act clarifies that its provisions do not alter or
 
 7 affect health and safety laws or insurance laws.
 
 8      SECTION 2.  Chapter 481, Hawaii Revised Statutes, is amended
 
 9 by adding a new section to be appropriately designated and to
 
10 read as follows:
 
11      "481-     Prohibition of discriminatory pricing due to
 
12 gender.  (a)  No person, partnership, firm, corporation, or other
 
13 entity engaged in business within the State shall discriminate,
 
14 with respect to the price charged for services that are the same
 
15 or similar in nature, against any person because of the person's
 
16 gender.
 
17      (b)  This section shall not prevent price differences based
 
18 on the amount of time, difficulty, or cost of providing the
 
19 services.  This section shall not alter or affect laws related to
 
20 health and safety or insurance."

 1      SECTION 3.  New statutory material is underscored.
 
 2      SECTION 4.  This Act shall take effect on July 1, 1999.
