Waikiki Commercial Catamarans

Allows owners of commercial catamarans having a commercial
registration issued by the Department of Land and Natural
Resources to transfer ownership to a corporate entity and remain
eligible to continue operation at Waikiki Beach under a
commercial registration issued to the new corporate entity.

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  Section 200-9, Hawaii Revised Statutes, is
 2 amended by amending subsection (b) to read as follows:
 3      "(b)  Vessels used for purposes of recreational boating
 4 activities which are also the principal habitation of the owners
 5 shall occupy no more than one hundred twenty-nine berths at Ala
 6 Wai boat harbor and thirty-five berths at Keehi boat harbor,
 7 which is equal to fifteen per cent of the respective total
 8 moorage space that was available as of July 1, 1976, at the Ala
 9 Wai and Keehi boat harbors.  Notwithstanding the purposes of
10 small boat harbors, moorage for commercial vessels and commercial
11 vessel activities is not permitted in the Ala Wai and Keehi boat
12 harbors; provided that commercial catamarans, for which valid
13 permits or registration certificates have been issued by the
14 department which allow the catamarans to operate upon Waikiki
15 shore waters for hire, may be permitted to moor in Ala Wai boat
16 harbor at facilities leased for commercial purposes.  The
17 department shall allow a sole proprietor of a catamaran operating
18 with a valid commercial registration certificate issued by the
19 department for a commercial catamaran to land its commercial

 1 catamaran on Waikiki beach and to operate upon Waikiki shore
 2 waters for hire, to transfer the ownership of the vessel from
 3 personal ownership to corporate or other business ownership
 4 without terminating the right to operate under the commercial
 5 registration certificate.  The existing commercial registration
 6 certificate shall be reissued in a timely manner in the name of
 7 the transferee corporation or other business entity.  No
 8 commercial registration issued to an owner of a commercial
 9 catamaran operating in the Waikiki area shall be denied or
10 revoked without a hearing held in accordance with chapter 91."
11      SECTION 2.  Any corporation holding a valid commercial
12 registration certificate issued by the department as of
13 January 1, 1999, to operate a commercial catamaran upon Waikiki
14 shore waters for hire and to land on Waikiki beach shall not have
15 its commercial registration certificate revoked on the basis of a
16 past error or omission executed by the department in allowing the
17 transfer of ownership of the vessel from personal ownership to
18 corporate or other business ownership.
19      SECTION 3.  New statutory material is underscored.
20      SECTION 4.  This Act shall take effect upon its approval.
